X Klamation

I have just bought a 2003 Jaguar XK8. I was told I would get a 12-month warranty with the car and when it was delivered by the salesman, I was asked to sign the warranty form that was then placed in a warranty booklet. I have now had the car checked over by an independent Jaguar expert (he writes for the Jaguar Enthusiasts Club magazine) and he has identified the following items that need repair: PAS Cooler weeping and needs replacing - circa £105 parts, £60 labour; Upper wishbone and lower shock absorber bushes - circa £232 parts, £180 labour; Front suspension V mounts - £52 parts, £150 labour; Lower arm left hand ball joint - £130 parts, £60 labour. Total cost circa £950. Which of these items are reasonable to claim for repair under a used car warranty?

The dealer who sold you the car is directly legally liable for all of these defects, which you have established were present on the date of sale. They cannot be covered by the aftermarket warranty because they were present when the car was sold. To claim on the aftermarket warranty would be fraudulent. So give the dealer the choice of rectifying the faults or taking the car back and giving you your money back. (He will anyway have more than £950 in his margin on the car, unless he made a very bad deal in buying it.) Law here: www.honestjohn.co.uk/faq/consumer-rights
