Winter tyres for Germany - regulations confusion

There is thread on 'Motoring Discussions' concerning what constitutes a 'legal' winter tyre for use in Germany.

There seems to be a lot of ambiguity and confusion - even between the usual 'authoritative' sources. How can a motorist be sure, especially if they get caught in an accident on snow in Germany, that their tyres will meet the regulations - especially when they find themselves under scrutiny by the police / lawyers / insurance companies?

Also, how can a buyer ensure they are being sold proper Winter Tyres? I have been offered tyres of dubious quality - yet I now have no comeback as they 'have some snowflakes on the tyre wall'.
Any advice would be much appreciated. Thanks.

If has a snowflake or a mountain symbol on the sidewall it qualifies. Some 'all weather' tyres qualify. Some don't. All cold weather winter tyres qualify.
