I received a fine for an untaxed vehicle without a warning - where do I stand?

Further to a recent letter from the DVLA regarding my (then) untaxed vehicle, I am writing to express my utter disbelief in the fine I have received. Please allow me to explain:

My van, which was parked on my land at the very end of a cul-de-sac, was moved from my drive to the road so I could move other vehicles from my drive - unfortunately, I did not return it to the drive straight away. There are no blocked access or issues - it has been parked in the same spot for years while I owned it and then taxed it at the time. But having bought a new vehicle I SORNed the old van ready to sell it and it is within this time someone has anonymously reported it.

My complaint is not about the van parked as it was, but about the fact that as soon as the DVLA placed a 'Warning Notice' on the Van it was moved and stored on my land - it was a mistake to leave it parked as it was. Due to my error, a charge of £142.00 has been raised to which I have appealed to the DVLA but it has been upheld and needs to be paid before 30/04/25 to avoid court action. The charge is not fair - think about every other issue, people get warnings before a fine, I did not receive a warning.

It is my intent to challenge this issue in court, if required - this will probably cause stress to my family. The van has now been taxed, covering the said period and has been sold

The normal process for an untaxed vehicle is that a fixed penalty is issued, either of £180 or £30 plus 150% of the outstanding tax. If the first communication you have received is a Single Justice Procedure then it may be that an out of court settlement or fixed penalty has not been delivered to you and you have the option to request that the DVLA reinstate a fixed penalty on the basis that the first communication was not received. If this is unsuccessful and court proceedings are continuing, we would suggest seeking independent legal advice.
