I would much appreciate your advice. I bought a 2003 BMW E46 M3 from a Honda dealership a few weeks ago. A "safety check", including a brake inspection, (agreed as part of the sale) was performed prior to the car being released and no problems were brought to my attention. I have just had the car serviced at 49,000 miles and the front brake discs were found to be worn to 2-3mm beyond the minimum replacement width recommended by BMW, the rear brake pads were fully worn as well as the rear discs needing replacement due to wear. Another problem noted was a broken rear coil on the shock absorber (a common problem). All have now been replaced. Should the dealer have brought these points to my attention and is he liable for the costs? I have been told by Honda that a brake efficiency test was passed by the car as part of their test and the car deemed safe as a result.

The selling dealer is liable for the costs, but only if you gave him the
opportunity to fix them and he refused. He is not liable for someone
else's work on the car if you did not give him this opportunity. The law
