I am wondering if you might be able to help me resolve an issue that I have with the DVLA. In May this year I sold my VW Golf for £950 cash to a private buyer. I completed the back of the registration document and sent it off to the DVLA. It now seems that the buyer did not complete his part of the form or that the DVLA has mislaid his document. I now have now record of the transaction apart from my insurer confirming that the insurance was cancelled and the bank credit slip to say that the money was deposited in cash. The DVLA is now expecting me to pay a penalty of £80 by 08-01-09 or £40 if paid by the 11.12.08. Also they are demanding tax arrears of £30.84. I do not see how they can impose this penalty. Will this be ongoing and do they seriously expect me to pay for someone else’s motoring? I can’t get my head around this one at all

That's right. It's Draconian, but as part of the continuous taxation regulations you are supposed to make sure you get confirmation from the DVLA that the transfer has been recorded. If you don't, for whatever reason, including DVLA negligence, it is down to you to contact DVLA and make sure it is recorded. Unbelievably unfair. But true. New style registration documents do tell you this in the small print, but not that you will be punished if you fail to check that the DVLA has done its job. Next thing they’ll be asking us to fine ourselves for speeding.
