Hi All

I know that I am playing while fire sometimes.

I was parked in a private car park of a sports club. Been parking there over two years now without any problem. Others drivers do the same when space available.

Now, they are double yellow lines on that part. Opposite, 7-8 meters away are parking spaces.

A woman still got the chance to reverse into my door and made a large dent. She nearly drove away, but witnesses were there and therefore went to reception and call my number plate.

Last, I still have not changed my number plates. The car is taxed and have the number plates in my boot, but never got around to fit them.

What is my position regarding the law?

Even though It is a private car park, does the law applies the same?

The double lines and my plates [although there are no time limit on when I have to fit them], do these stop me claiming against the woman?

The double yellow lines will have no legal force if they are in a private car park, SFAIK. On a public road they have to be authorised, and put in place by the local council or a contractor acting with their authority.

You can use a civil action to claim.

The fact that you imported your car from France in 2012, late summer, but haven't bothered to fit legal plates yet suggests that you're taking the p**s over legalities.

Check with local council to see if there is a No Waiting Traffic Order for the yellow lines as as say.

Irrespective of the illegalities on import/registration/SORN the car is still 'property' and the other should be covered against damage?

How do I deal with insurances?

Do I have to contact mine even if she is in the wrong? Is it my obligation to notify my insurance in either case? Right or wrong?

She gave me her details and said she has fully comprehensive insurance, to feel free to contact them, Hastings Direct.

You should inform your insurers and it shouldn't make any difference to your premiums if full recovery from the other party is made. If you do end up getting a nasty surprise come renewal time and they won't back down, that's a cue to change your insurer.

They'll probably try to point you at some accident management company, but you're better off telling them to naff off and claiming directly from her insurers.

I have just contacted her insurer, Hastings Direct, she admitted being in the wrong and they will pay for all the cost.
