I collided with a height barrier at the entrance to a car park that is owned/leased by the Co-Op. I was driving a hire van high sided transit type and hit the barrier at the entrance to the car park.

The barrier was goal post type with fluorescent stripe on the crossbar.

The barrier was not displaying any warning signs or height and I was hoping that this was a breach of some legislation or regulation so that I can claim the £900 excess I just paid to the van hire chaps!!

Any help or advice will be greatly appreciated.

Sorry but if you are daft enough to drive under a height barrier in a hire van without checking first you deserve all you get.

Be thankful the Coop have not charged you for any damage.

I think this one is down to you.

Was the barrier damaged at all, a fair bet it was If over £900 of damage was caused to the van.

Do the Co-Op know it was you that hit their barrier ? if so they might be chasing the hire company for the damage caused as well.

By your own admission it had a fluoresent stripe on the crossbar, which must weaken your position.

Was it daylight/ night, what was the visibility on the day ? , any signs banning goods vehicles ?
