Hi everybody I know the illegally parked Vans is always a popular topic however in my estate which is a neew build the deeds state no vans to be parked in public parking, basically our estate is one big long street with house on one side a park accross the other every 50 years there are parking spaces for 2 or 3 cars now there are people parking there vans in them i would mind so much but they have drive ways but the property deeds clearly state no vans to be park in public parks what can i do?? ive approached the offenders which is hard enough and they were not interested what would be the next avenue? you advice is greatly appreciated

What do you expect them to do. The vans are most liekly to be their bussiness transport, without them no bussiness. You would not want to park your vehicle miles away for security reasons alone.

Our deeds state no caravans, no chickens and no more than 2 dogs. People up and down the street have caravans, one chap (policeman) has 4 dogs and our neighbour plus another 2 families down the street have chickens. Does it bother me, of course not, its doing no harm.

Let them carry on with their lives, if it was illegal activities you would have a point but its stupid covenants written for no good reason.

If you really want to make yourself popular get a solicitor to write to them saying you will take it further if they don't stop it. I know what i would tell you to do.

These sort of covenants have been in residential housing schemes at least since the thirties and the expansion of Metroland. Frankly while they serve a purpose in extremis they're a throw back to when owner occupation was the preserve of the salaried middle classes. Keeping fowls (or pigs), having a signwritten van or, heaven forfend, carrying on a trade or profession other than Doctor, Architect or similar would be thought to lower the tone and make life intolerable. Those chaps might even want to join the cricket clud!!

Nowadays, or at least until the 'crisis' bit owner occupation is the norm. Our local estate built for bank clerks, teachers etc is now occupied by people in all sorts of trades.

In a rational country we'd have had a Residential Property (Regularisation of Restrictive Covenants) Act thirty years ago to sort this out. But as we don't we havn't !!!!

These covenants are essentially to "protect" the developer until the estate is complete and all house sold. Most residential houses have covenants forbidding ANY form of business - which literally means no Tupperware parties or taking work home, but "everyone" does.

Property owners and tenants should be allowed to do what they want on their own premises as long as it's legal and doesn't cause nuisance to others.

I've a covenant on my property (is it a covenant you're referring to?). When I looked into how it's enforceable, I discovered that all that could be done was if I sold the property, then the buyer's solicitor might be aware if I wasn't conforming. I couldn't discover any means of legally enforcing the thing.

Didn't that question of you and its got nothing to do with me wanting to get on peoples wrong side its got to do with the fact that I own three cars one van and have a garage yet still manage to keep all my vehicles of the street its got do do with the fact that people are taking up to much room when if they organised themselves could leave room for the people who dont have on street parking.

I have lived 12 years on a 100+ house estate which, while large, has no thru traffic. Nobody is incovenienced by the parking of caravans and large white vans; we can all get around the estate, people have to live and make a living so none of us can really be bothered with the enforcement of an archaic and largely irrelevant covenant. Not the situation for some other estates I appreciate
