hi,

My car was parked on the road and a car hit it and did not stop. A passerby witnessed this and left a note on my car with the car registration number and a brief description of what happened. The witness did not leave their details. I reported this to the police and they said they will not be taking it further because of the evidence provided and the minor damage to my car.

I am stuck as to what to do next. If i report to my insurance company and they are not able to get the driver to admit liability, i will be stuck with a £250 excess, lose 2 years ncb and increase in premiums. if i do nothing my car is devalued due to the damage. if i repair the damage myself i am out of pocket.

any advice?

No you won´t the other insurance will pay for it if they think fit or you will pay for it yourself or you will not do anything.But you must report it to your insurance company as you have already reported it to the police.

Report it to your insurance company, but hold off having any repairs done until the insurance company investigation is over, then decide whether to go through insurance or pay for the work yourself.

The trouble is, even reporting, but not claiming on your insurance, is likely to mean a black mark come renewal time.

What sort of details were left? If it's just something like ' A car reg number A123 BCD came down the road and hit your car' then if I were the owner of said car, I'd deny all knowledge and say I was round my mates at the time. If it's a bit more detailed with car make, colour, time of day, maybe how many were in the car etc. you may stand more of a chance. But the fact remains, you don't actually have a witness who could stand up in court.

How much would the damage cost to fix. Anything less than a couple of hundred quid, I'd put down to (bitter) experience.

I've just gone through an almost identical experience to yours .

To explain , I was in a local supermarket car park ,I saw a driver of a skoda collide with the rear of my mother in laws Suzuki . Her car was unoccupied at the time .

The other driver attempted to drive away ,I insisted that she stopped and she reluctantly gave me her name and address . However she then refused to report the incident to her insurance company ,saying that no accident occurred .

We had the Suzuki repaired at a cost of £800 , under a comprehensive policy .We then waited for the insurance companies to sort it out .After 6 weeks and numerous conversations ,I told our insurance company that if it wasn't sorted out in 10 days I would pursue the other driver , not her insurance company , through the small claims court .We were paid in 7 days by the other drivers insurance company .
To summarise find out how much it will cost to have your car repaired ,if its more than £500 ,it's worth pursuing .
First look on the mib website ,to see if the other driver is insured ,if not report report them to the dvla and the police .

If they are insured ,have your insurance company ,contact thier insurance ,if they won't admit liability ,sue the driver through the SMC ,it's a simple process ,the cost to you ,which you should recover is about £200 .
