Can you arrive in the UK at Folkestone in a UK car, without tax or up to date MOT and get away with driving to a pre-booked MOT in Leeds? Without of course being fined and this ruining my Christmas when I plan to return to the UK in three months?!

I didnt deliberately go overseas to avoid paying tax, etc. it was just that i left in july and my MOT was in September and so i missed it and thus couldnt get any road tax.

Knowledge and advice greatly appreciated!

Schedule 4 Vehicle Excise and Registration Act 1994.

22(1)A vehicle is an exempt vehicle (Re Excise Duty) when it is being used solely for the purpose of—

(a)submitting it

MOST IMPORTANTLY:

(by previous arrangement for a specified time on a specified date)

for a compulsory test .

and

Reg 6 Motor Vehicles (Tests) regulations 1981

(2) Pursuant to section 44(6) the Secretary of State hereby exempts from section 44(1) (Test Certificate) the use of a vehicle—

(Most importantly)

(a)(i)for the purpose of submitting it by previous arrangement for, or bringing it away from, an examination

In neither case does it stipulate that it has to be taken to the nearest Garage although it is stated that taking a vehicle from Cornwall to John of Groars would be frowned upon and shoud therefore what is proposed PROVIDING test is pre=booked ( and recorded so)

A cautionary note is that this does not cover any defects which may be found if stopped and for which the vehicle could be put off the road and driver/owner reported for offences committed in relation to Con and Use and Lighting regs. One should therefore check before hand that beast complies with MOT requirements (

Would save a lot of hassle if test could be arranged near port of entry.

I agree the best solution is an MoT near the port of entry.

As dvd points out, the regulations are open to interpretation.

If you are stopped on the way to Leeds, and particularly if the appointment is the next day, it may look as if you are trying to get a 'free' run home.

If you are stopped in Folkestone, having just landed there, and are on the way to an appointment in Folkestone, you are clearly doing everything you reasonably can to comply.
