vovo xc90 d5 awd 2003 - cambelt tensioner - just my luck

I have been reading previous reviews regarding the disintergrtion of cambelt tensioners on xc90 can anybody let me know what there outcome was? My story briefly is: bought a 2003 xc90 with 64400 miles and was given a 28 day warrenty by the garage. On day 30 returned the car due to a loud knocking noise, the garage told me to "take it home and bring it back tomorrow and the mechanic will have a look at it for you" - guess what never made it home!! It now needs a new engine. Initially the garage offered to cover all costs of the repair if I contributed £400. Now two weeks later and my car still in pieces on the garage floor they have renaeged on there promise and are now offering to cover the cost of labour only to have it repaired once I have soured and paid for a new engine. I would appreciate any advise on where I stand / what I should do next.

I think the garage may have responsibilty if they advised you to drive it home with the nocking noise ! their judgment should of been better than that! As a proffesional advisor they should of advised you not to drive it.

I fear you may need to ask Lucy for some advice .

Cambelt/tensioner failure is common on these and am suprised it was not replaced before sale !

If you look under 'Volvo xc90 cambelt tensioner disintigrates'...I have just finalised the thread with the outcome for me. As for your problem you don't state it was the cambelt tensioner only that there was loud knocking. In any case if you buy a car from a dealer and there is a problem in the first 6 months that could be caused by an inherent defect then it is assumed that the defect was there at the point of sale. After 6months you have to prove it was there yourself. An inherent defect can manifest it self up to 6 years after purchase. The 28 day warranty that was given does not take precedence over your consumer rights under the Sale of Goods Act 1972...it is merely ancilary and doesn't let the dealer off the hook...far from it! Get a copy of the S of GA 1972 and have aread it may help in your case. Legal expenses insurance that may have been provided with your car insurance coulkd help. Intially they have a help line that advice can be given. I have to say that tenacity in these cases is the key. Don't give in at the first hurdle.
