in march 2010 my 2002 rangerover hse was stolen from where i live and work.

I had the only key to the car and had left it locked before going to bed, when i came down in the morning the car had gone.

the insurance company have refused to pay my claim stating that they believe i had an involvement in the taking of the car.

i have issued court proceedings against them but it is beginning to take its toll, they claim that the car cannot be stolen without the key. I have been in contact with a locksmith who states that he could make a key for it and that you can gain entry to the car without the key which he also did when i locked my keys in an x5

does anyone else have any suggestions on how i can fight the insurance company and demonstrate that the car could have been taken without the key ?

Not a legal reply but do you still have the key ie it was NOT used to drive the car away? Where is/was the spare key? Has it really taken you 15 months to get this far with your claim?

Re your query I suggest you get a written statement from your locksmith the possibility of it being opened and stolen without a key. An X5 may not be the same set up as a rangie.

I still had the key its now in the possession of the insurance company, I only had one key when i bought the car unfortunatly and being a bit lapse i didnt get another key made.

the locksmith has put in writing that you can gain entry but im looking for more to add to give the insurance company no room to manouvre.

it really has taken 15 months, they took 8 to say they wernt paying the claim and the rest has been the great british legal systems timescales for county court action

Was the vehicle recovered? In there any possibility it was stolen by people with access to the keys (without your consent)?

the vehicle was never recovered and i only ever had the 1 key

I'm sorry to hear of your distress ! This appears to be a very common reply from insurance companies now and have experinced several people in the same predicament! On one of the L/R forums there was a guy who had his FL2 stolen from a pub and he still had both sets of keys but the insurance said that its impossible to steal, this is nonsence as they are often recovered on a lorry or the steering lock forced and towed ! often just being used for a ringer or spares abroad ! The guys FR2 was found burnt out ! but insurance still refused so he had to pay himself fro new interior from S/hand crashed and cost him about 4K.

Any car can be stolen without a key, just may not be driven as the key holds a micro chip for the engine ECU. Word of warning, most insurance companies require you to report a missing key and most will insist on new locks and the old key codes being deleted from the ECU !!

Just two mentions you may consider;

1. Metroploitain Police or Greater Manchester Police run a Stolen Vehicle Branch and as experts in the field how do they do it you might get your question asked.

2. Land Rover Owners Club run a Web site where in their forum there are a lot of dedicated Landy users who may give you some guidance.

After 30 years as a Traffic Plod if they are going to nick a vehicle then there is nothing in the market that will stop them. Research the cloning of the key trick where when you bleep someone nearby with the right equipment copies your signal and uses it later to take the vehicle.

On the landy forums there are plenty of people had their RR's stolen without the keys !

There is also a register for stolen vehicles and some sucess at finding them as well !

Theres no such thing as a car which cannot be stolen. I can think of at least three ways to take that Range Rover without the key. Your insurance company needs to do some research.

You may be better going down the route of the Ombudsman, although this takes along time, they tend to look at what is fair and take into account the knowledge on Insurance of the average Joe Bloggs.

If you are not happy with their decision you have the option of going to court.

A court looks at black and white and the judgements are based on the law, if you're not happy with their decision you cannot then use the Ombudsman.

Did the OP have it in writing that the insurance company believed he was involved in the taking of the vehicle? That would have to be worded VERY carefully I would imagine.
