2010 Santa Fe - Manufacturing Known Defeat (Cruise Control) - djashjones

I brought a brand new Santa fe 7 seater at the end of november last year. I do alot of motorway milage and noticed that the cruise control did not work. I took it back to the dealer for repair. They were unable to repair it as they are waiting for a fix from hyundai.

I know of other people that have the same issue and are still waiting. What are my options as having cruise control was part on list of items i wanted?

It's too trivial an issue for either a refund or a replacement. Your option is to get it fixed and you should be pressuring the dealer to pressurise the manufacturer. You may gest some other benefits in the form of a service voucher or similar but as long as it is fixed in reasonable time then repair is your remedy.

so basically, its ok for a manufacturer to sell a car stating it has a X feature which never works off the production line and fix the issue at their leisure? Thats kind of what your saying Lucy. If i'd known that when buying a car then i might of brought something else!

You are trying to imply that every Santa Fe has the problem when they do not.

You have a car with a minor fault which doubtless will be fixed. You should obviously keep the pressure on the dealer to rectify it as quickly as possible.

You mention that "as long it is repaired in a reasonable time". I have had this issue since purchasing my car in June 2010. The fault was reported to the dealer on the same day as purchase. It is now nearly 8 months later without resolution and after contacting Hyundai UK 3 times. Their response each time is that they cannot commit to a fix yet.

Keep pressing the dealership. If you can show it is a "common fault" then there may be more room for negotiation but doing a quick Internet search I only see a cruise control problem mentioned in older model vehicles. If you can show me evidence for otherwise I would be happy to look and maybe we can get some reaction from Hyundai.

Lucy,

Thanks for you prompt reply. Details of other owners having the same issues can be found on the UK Hyundai owners club forum and the wroldwide one as well. I have picked up the same issue owners in Australia are having as well. The fault only seems to affect the manual transmission cars. The links to the the forums are as follows:-

Lucy,

Forgot to add:-

When I logged this issue with the purchasing dealer on the same day as buying the car, the service manager told me it was a known issue and should be fixed within 4 weeks via a software upgrade to the ECU. I have spoken to Hyundai UK twice, the latest being January when they told me they could not commit to a fix. The demo car I test drove back in April 2010 had the same issue and at the time I did not think too much of it as I was concentrating on other parts of the vehicle whilst testing it. I was not told at any point during the sales process that there were any issue with the car or the in particular the cruise control.

Andy

Most Santa Fe owners have had the problem fixed under warranty by adjusting the clutch switch.

I had the clutch switch adjusted as far as it would go by the dealer. It improved the issue but it still happens when clutch burning in traffic jams for e.g.. Hyundai UK still have no fix for the dealers and are quote "waiting patiently" for Hyundai Korea. I am past being paitient but they are now ignoring further pressure.

My next step will be a small claim re a failuire to repair under warranty

How will you assess the monetary value of losses you've incurred? AFAIK the Small Claims Court is only useful to have it fixed elsewhere at your own expense and then claim the cost back - but if it can't be fixed .........

Heard it all before. Letter from Customer services is standard letter to all. My next step is the legal route under the sale of goods act. Repair, Replacement or Refund

Normally use Chrome but I have never had a problem with IE8. Posting this with IE9 thus it may or may not appear. Usuallu have to quote previous message to get it to work in IE9.

I am in a similar situation and am at the point of involving a solicitor. I have had a new control unit fitted to the car and it has been back into the Hyundai dealer twice subsequent to this. There is obviously a problem that they cannot rectify and, therefore, must offer a suitable solution.

I will post my progress on this matter, meanwhile I would be interested to hear further from people who have already started legal action.
