MINI Cooper + Cooper S - Damage cause by loose drain cover - timmy79

Hi,

Recently at a Tesco service station, where we drove over a drain cover which flipped up and damaged the car.

There was no warnings in place or signs & couldnt be avoided, as it is the exit to the station.... it appears to just come loose and damaged the side mouldings & rear bumper.

We did speak to Tesco manager and go through a claim form and they state that the cover caused the damage...

However speaking to our insurance this morning, they said Tesco probably wont pay out & Tesco have said that someone will talk to us in about 14 days.....

My question is, is this the right way to deal with this, does it really take 14 days before Tesco even call us & can Tesco get away with not paying??

Any advice would be great.....

You have to show they were negligent but in most of the cases we have dealt with like this the supermarket tends to settle if it is caused by a defect in the fabric of their site.
