hi guys- don't worry I'm not expecting any sympathy whatsoever and I hate myself so much for my particular situation, but wondered if you could advise?

3.5 years ago I was involved in a crash and I was uninsured at the time. My insurance lapsed at Midnight, and I was intending to buy my new policy at 7am when my wages hit my bank. Darn stupidly I drove in between. Our cars touched on a roundabout and the other driver was young and going at a fair speed- I was doing less than 35mph. The other driver over corrected and basically their car came off far worse than mine. I'm a single mum.

I took the points and paid the fine. Over the course of the next two to three months I had letters from MIB and insurers and replied to them all, which asked for me to submit drawings and my version of events. Then all letters stopped. I heard nothing for a further 4 months. I moved home about 6 months after the incident.

I have now had a year of threatening letters from this insurer asking for more than £5k. They send me rubbish printed standard letters claiming to enclose a breakdown of costs. I've never had this enclosed. I can only pay money by installment and it will take a while to pay off what they ask- but I will not pay anything without seeing the breakdown of the work they've had to do and have written on three occaisions asking for this. They don't, but simply continue to send threats of action. I'm happy to try and sort it but surely I should get a bill of costs and what the money was spent on? I'm now beside myself with the stress of what will happen next. The last letter I sent was last week.

What would you expect to happen?

Is the claim from the third party insurer or the MIB? The other question is why was this not settled 50:50 as most roundabout collisions are (or was it)?

Just because you were uninsured does not mean you were at fault, in fact we often deal with non-fault cases where the non-fault driver was uninsured and recover their losses perfectly successfully.

Thanks for that- so how do I seek representation? I've been hoping to deal with it myself as I'd struggle to pay lawyers fees- can I do this by offering to pay half?

I think I had to outlay only about £300 including my recovery and repairs, and a day off work. I understand that the fine is mine to pay and I did.

I think the main problem was that the letters went quiet for so long and I moved house not realising I still had matters to deal with.

Question: If poster has Home Insurance with Legal Protection pack on it can this be used to fund her attack or must one have the Legal pack attached to Car Insurance to deal with a car matter?

On the AutoLaw policy it would be covered by the basic policy. Really though it's a liability issue so if an uninsured driver is in a non-fault accident they should recover all their losses in full. They claim is made directly against the insurer of the at-fault third party.

If the MIB haven't been dragged in it is likely that they disputed liability and hence the claim went back to the insurer. If it had been a clear fault accident the MIB would probably have settled it and they would have come at you for the money.

I need to know the amount they are claiming and a brief outline as to the circumstances of the accident, what the damage was and if anyone was injured.
