Hi, can you please advise me, I ordered a Hyundai ix35 on 15th May, with an expected delivery date of 31st July.

When I placed the order the dealer agreed a part exchange price for my old car which he put in writing on the invoice, with the outstanding balance due to be paid at the time of delivery. (less my £500 deposit). Have been told the car has just arrived in the UK and should be with me in a couple more weeks, however dealer is now implying that he will not honour the original part ex price which I have in writiing on the invoice, my car is in the same condition it was when he agreed the price - can he do this ?

2000 miles since the order was placed 5 months ago, the car is still a low mileage vehicle for a 5yr old car doing an average of 5000 miles a year.

I think you should hold him to it as part of a binding contract with you always willing to uphold your part of the bargain. Given the age and mileage any change in value should be minimal

although the majority of vehicles will depreciate each month normally in accordance with glases guide values your dealer should honour the original value for your part exchange and seek a claim on the manufacturer for his loss- not the dealers fault - he doesn,t make the cars.

That is exactly what I thought he should do, however after meeting with him today, he is insisting on reducing the value by £1000, I am not sure where I stand legally as I really want the new car after waiting 5 months for it when I was originally told a 2 month wait, there is no damage to the car and the mileage remains low. I think I will end up having to pay the extra £1000, but am considering legal action after I take delivery of the car for his breech of contract of the original contract we both signed in May.

can't say too much, but tapping my nose with my finger, a little bird tells me that the delivery problem of new IX 35;s is common knowledge and Hyundai themselves are offering £500 worth of free accessories as a sweetner - (nudge nudge wink wink)- contact Hyundai customer services if your dealer isn,t responsive to this. cheers
