Hi there, I am new here so I hope I have posted in the right place. Back in August, I was hit from behind by a van. My insurance really messed me around and eventually my car went into repair with their approved garage. The only damage from the accident, was the bumper being damaged, not major. The car already had dents at the front and some scratches.

The car was a cat c write off and I brought my car back. I was told I would need a new mot and vic check done. The car passed the mot but then my inurance informed me on 3 occassions that I would not need the vic check done. They told me once the car had been mot'd then my cover would go back up to fully comp. However, my insuarnce then phoned to tell me I was no longer covered until I had the vic check done. I complained and told them what I was told by other members of staff and was then told I was covered third party only.

My road tax was due to expire at the end of Oct, so I was advised to get new tax just in case the vic appointment took weeks, so I purchased the road tax for 6 months yesterday.

Please can you help me answer these questions.

1) I did the vehicle enquiry on my car. The tax is still showing my previous one which expires at the end of October. It is not showing the expiry date as end of March. I purchased the tax from the post office yesterday and phoned the dvla and they told me to put the new tax in. Is this correct as I do not want to get in trouble for not placing the correct tax disc in my car. I do not think I have grounds for a refund fot the month left on the current tax disc, am I right?

2) Do I really need to have the vic check done? I have sent my insurers copies of proof of purchase, copy of the Vehicle reg doc and other documents they asked for. I have 6 months tax, 12 months mot and I am insured and I own my car, so why do I have to have this done? My nearest centre to have this done s very far away and not only that its going to cost me more money which right now I cannot afford. I was informed that if I did not have the vic check done, I would get stopped by the police. Which I do not want as its embarrasing lol and it would probably frighten my young son.

I googled and if it was Cat C, it will have a VIC marker placed against it, so will need to have VIC done. There is quite a bit of info on the direct.gov site.

It says you can check if a VIC marker is against the car by calling VOSA on 0300 123 9000. Might be worth doing for peace of mind.

Thank you for your reply. Yes I checked my vehicle and it has been marked as needing a vic check. The website does not state whether or not it is a legal requirement however. Fingers crossed I will be ok to drive until an appointment comes through and hopefully I will not get stopped by the police. Thanks again for your advice and help.

On the tax issue as long as the vehicle is continuosly taxed you should be OK. You should have commenced the new tax at November. I would show the old tax disc until the end of October and put the new disc in on November 1st.

I think you would be able to successfully argue that insurance was in place until the VIC takes place (subject to passing) but if they have notified you that it is not then it is a tricky issue. Get the VIC done asap. The fee is £41. Borrow it if necessary as not doing so adds complications you don't sound like you need.
