Quick question for the backroom boys in blue

Daughter was rear ended at Handy Cross (M40 j4) on Monday by a 4x4 which then drove off.
She got his number and called the police - not showing on insurance DB. They asked her to go to High Wycombe police station to make a statement, which she did. They are following up trying to find the offending vehicle.

However, they gave her a producer to go back to HW police station with MOT insurance etc. We can find the reg and insurance documents but not the MOT which was due to expire on Friday. It was already booked in to get MOT done on Thursday, should be OK no lights damaged or whatever but am I right to assume -
1) She needs the current MOT not the new one we will get on Thursday
2) I need to get the garage to print me a copy before they do the MOT or they will not be able to print the 2008-09 certificate once the new one has been done.

Anyone know?

They should be able to provide a copy of the one you need. In a different situation, I took my bike for a test a couple of weeks ago... about a week out of date. I usually take the V5 so the tester doesn't have to hunt for the frame number. I apologised and he said 'No problem', typed the reg no in and brought up the expired MOT with the frame number. I'm sure they are not wiped off the DVLA database when they expire.

Thanks my concern is/was that the new one on Thursday would "overwrite" the old one, don't know how far back the garage can go down the stack.
Wondered if the police requirement for seeing the one valid on Monday was important since they could (and probably did) check on the DB on Monday that the car had one.
I can see they need to see the current insurance documents since that's the best way to show that daughter is named on the insurance not just that the car is insured.

1) Yes, she must be able to show a valid MOT for the day/time of the accident. It should have been checked on the database at the station and therefore there should be no need for a production requirement. But this is not law, she can be required to produce and there may be some reason for this (IT systems down at the time, new support staff member lacking training etc)

2) Don't know whether the old one is retained on the system - nothing to do with the Police.


Not terribly helpful I know, but a part answer nonetheless.

The original testing station normally holds records of tests for twelve months;before that date you would need to go to the DVLA.

The garage who do my MOTs hadn't tried to get copies of non current ones and weren't sure they could, have ordered one now before they do the new test tomorrow just to be sure

DirectGov website says you can get a duplicate MoT at any garage, not just the one that tested the car. There are also a number of websites that will (forthe fee) issue a duplicate if you provide the required data.

The concern I had which I wimped out on and ordered one today was whether I would still be able to get the MOT that was current on Monday after the car had passed a new MOT test on Thursday. Garage thought not, I would still be interested to know if there is a way of getting a copy of an expired MOT certificate.

While it may not be possible to get a duplicate for an expired certificate, I can't believe that the database loses the prior history of MoTs etc. It must be possible for VOSA to produce the information, and I'm sure the police can request the info.

While the 4x4 is uninsured, quite possibly un-roadworthy, and may even be using a bit of "liberated" red diesel - and stolen, for all we know.

And the police wonder why some drivers don't know whose side they are on.....

For Pete's sake! All they have done is asked for the OP to produce the relevant documentation which is standard practice for anyone reporting an RTC and quite rightly so it could easily turn out that the OP was also committing offences. Just because they have become a victim does not negate their own legal responsibilities.

Now back to the original problem. There should not be an issue when on production the OP explains that they are unable to find their MOT Cert. If they are absolutely certain that it is current then it should be fine. A quick check on PNC will validate the date of expiry. It is not standard practice to take someone to court for 'Fail to Produce MOT' on its own.

David Horn - if you read the very first post you'll see that Police took an evidential statement and in Commers words are trying to find the offender. So your post does nothing to answer the question posed. Someone's missing the point then. Why not just post a 'Police bashing' thread and get it all out. You'll feel better and we can all ignore your juvenile ravings.

For the record neither my daughter, my wife or I have any problem whatever in the requirement to produce the documents.
From what my daughter has said the police she has spoken to were supportive and helpful and are going to try to sort out what they can of the other driver, no complaints whatsoever.
The producer, as far as we are concerned is routine no more no less.

I will post again if we get anywhere
