After checking up on my car, which was left overnight at the roadside, the cops obviously noticed that it wasn't insured. They then came to my house and spoke to my partner who told them I was at work. He doesn't drive and has nothing to do with the car, yet the Officers gave him a HORT1 requesting to check the insurance. Obviously the car is now insured but the HO/RT1 names him as the driver. The insurance does {this is transcribed exactly as the poster posed the question - PU} as he doesn't drive the car, so how can he walk into a cop shop and produce insurance documents that have nothing to do with him ? Will he get done ?
Wae (sic) there being no insurance on the car at the time the HORT1 was given even though he was nowhere hear the car or will I get done ? Can you advice me thanks ?
Post re-written so that the poster was not SHOUTING. There has had to be some editing of the post as the poster had not used any punctuation marks. The word "wae" means nothing to me in the rudimentary grasp I have of three languages and has been left where it was also a rather ambiguous question left exactly as the poster left it..... No it wasnt isured at the time and place the cops saw it what happens there. But My partner has the ho/rt will they come back to me about it

Your "partner" does not drive, and "has nothing to do with the car". You have, however. I suspect that this clerical error by the "cops" will be corrected directly.

Presumably the owner of the car is responsible for it being tax and insured if on the road (not SORN).
But don't you just get a 2p fine or something for this kind of thing now-a-days?

Plod can only issue RT/1 for Insurance to be produced to
(1) Any of the following persons?
(a) a person driving a motor vehicle (other than an invalid carriage) on a road, or
(b) a person whom a constable has reasonable cause to believe to have been the driver of a motor vehicle (other than an invalid carriage) at a time when an accident occurred owing to its presence on a road, or
(c) a person whom a constable has reasonable cause to believe to have committed an offence in relation to the use on a road of a motor vehicle (other than an invalid carriage),
must, on being so required by a constable, give his name and address and the name and address of the owner of the vehicle and produce the following documents for examination.
(2) Those documents are?
(a) the relevant certificate of insurance or certificate of security (within the meaning of Part VI of this Act), or such other evidence that the vehicle is not or was not being driven in contravention of section 143 of this Act as may be prescribed by regulations made by the Secretary of State,
Non of the above appear to apply in relation to the person to whom RT/1 given. He is not the Registered keeper/Owner of the vehicle so has no obligation in relation to Insuring the vehicle or dictating as to who can drive. He cannot therefore be reported for any offence.
Not privy to the occasion it may be that Plod being assured that vehicle was Insured and to save time in chasing the absent owner has asked the person (who has contact with owner) to have Insurance produced and issued RT/1 as a reminder - wrong at law but a time saver).
Now what to do.
I would suggest person with RT/1 and the owner of car with the Insurance Cert go down to the Station that was elected for Document production per RT/1 and explain. Don't be surprised if the owner of the vehicle is reported for using a vehicle without Insurance (or given Fixed penalty Ticket - 200 notes) for that is the only offence I see committed.

If a vehicle is insured WHEN it's parked, I didn't think it needed insurance WHILE parked, even on the highway, until it's next USED.
If a vehicle is legitimately driven, on say a trader's policy, and then parked without the registered owner being insured, has an offence been committed?

I'm sure this has been discussed before and the result was that a car must be insured even while parked.
back to the OPs original post - it sounds like it's no so much much an allegation but a fact, in your own words you say the car was not insured.
I would expect the owner of the vehicle to get some sort of fine for no insurance. Having the insurance now is too late, unless you managed to get it backdated (very unlikely!)
