Will the current postal strike invalidate thousands of issued NIPS which may not be delivered within the required timescale?

My understanding is that it depends when the NIP is posted, not when it is received.

My Understanding is that if they say they have posted it you are deemed to have received it but not not ncessarily within the legally required timescale and certainly not when moved around he country by a "Service" that is on strike and loses ten of thousands of items very week even when they are not on strike!

According to www.lawontheweb.co.uk/crimertonip.htm
"A notice sent by post must be dispatched so that it would reach the driver within the 14 days within the *ordinary* course of the post. If this is the case then it will have been deemed to have been served even if it is delivered outside the 14 day period."
So no joy it seems. :-(

With a well publicised national postal strike under way then I would have thought that the *ordinary* course of the post had gone out of the window. (And not in through the letterbox :) )
Surely this is a reasonable defence.
To ensure delivery of a NIP, now, I would expect another system to be used.

Well there was this guy "Nick Freeman" not sure who he is (googling him shows him to be a hotshot motoring lawyer), on R4 this morning. And he said if you don't recieve your NIP within 14 days because of the postal strike, then it has not been correctly served. And that you should ask the ticket office to drop it. he also said it would be best if you can show that it was recieved/posted late. He mentioned postal marks but I don't think they always have postal marks on them these days.
If you can catch the postman when he delivers it you could ask the postman to write on it delivered xx xx 2007.

posting NIPs using Royal Mail during the strikes seems to me that the poster is not taking reasonable care in serving it.
There are plenty of other couriers out there that could be engaged to deliver them in a timely manner.

It's funny how the authorities can assume that their mail has been delivered, while the consumer would have to use recorded delivery.

Except that our post (East Mids) seems to be as normal - got my Auto-Express (motoring link!) as usual on Wed and a book I ordered on the internet on Sunday arrived today (along with my credit card statement and phone bill , worse luck!)
