BMW X1 - Possible speeding ticket - Redcar01

Hi All

So coming home from holiday in the 3rd lane I went past a bridge with speed camera van on it , looked down and it showed 80mph, will speedo be correct and if a bit of leeway do you think I will get a ticket ? Thanks

Your speedo is probably reading slightly high (some quick Googling suggests maybe ~2-3mph). APCO/NPCC speed enforcement guidelines suggest +10%+2mph but not all police forces go by those. If the speed limit in force was 70mph it is going to be a squeaker ...

If you have got zapped then it's not excessive so a speed awareness course should be offered. Worth doing to keep the points off the licence and they are quite useful, apparently ;-)

Speed awareness courses continued throughout Covid, only you had to complete them on Zoom.

They're now starting up classroom sessions again although not well advertised.

(a) All forces in England & Wales offer them. They are a good little earner as the police get a cut, so Chief constables are quite keen on them. They are not offered in Scotland.

(b) As above, they resumed online quite quickly after Covid struck.

To be eligible your speed must not have been above (Limit + 10% + 9mph) - so up to 86mph in a 70 limit - and you must not have done one for an offence that occurred in the three years prior to the current offence.

I would say that most cars tend to read higher than 2-3mph over at 70-80 on the speedo - my car is more like 4-5mph over then, but far less at 30 to 40mph. Satnavs can (if good quality) give a more accurate reading, but even then I wouldn't rely on them to bump right up against either the posted speed limit or the Xmph +5 or 10% +2mph rule for getting nicked or your car's photo taken by a static camera.

In theory, HGV's speedos should be better calibrated, but even then relying on other vehicle's speedos to drive as 'fast' as is legal is probably not the safest or most wise course of action.

I agree (mine is ~6%) but when I Googled most X1 owners posting were saying that their cars overread ~2-3mph @70mph compared to satnavs.

OK - fair enough. I suppose its more to do with being 'safe than sorry' to keep below the limit than trying to keep the car technically speeding but below the threshold that static cameras will catch you. Technically a police officer can stop you if you exceed the limit by 0.1mph if they are so inclined, though perhaps not legally obliged to give you a ticket.

I got done doing 31 through a village years ago but thankfully because my license was clean I only got a speed awareness course, I have heard of others who have also been done doing 1 mph over the speed limit.

If your speedo was showing 80 then expect a Pixed Penalty Notice through the post.

I have heard people say they have been "done" for 1mph over the limit. I have never seen any evidence of that. All forces in England & Wales operate to the National Police Chiefs' Council's guidelines (of action beginning at (Limit + 10% + 2mph)). One or two extend that to +3mph. Can you remember what force it was that took action for 31mph?

As I said earlier, Fixed Penalty Notices are not issued for speeding offences. What you (or the Registered Keeper if it is not you) can expect is a Notice of Intended Prosecution (a NIP) accompanied by a s172 request for the driver's details. When the driver has been identified he can expect either the offer of a course, or a Conditional Offer of a Fixed Penalty or notification of court action (mainly depending on the speed alleged and his eligibility for any court-of-court disposals).

I assume it was a 20 limit if you were reported for 31. It certainly wouldn't be a 30 limit, unless it involved a roadside stop and a failed 'attitude' test.

He would have to convince the court that he was able to tell the difference between a car travelling at 30mph and one travelling at 31mph. Even with a properly calibrated speedometer, he may struggle to do that. The NPCC's guidelines exist mainly to make an allowance for equipment tolerances (although in practice the allowance made in the guidelines far exceed the tolerances of the equipment). The guidelines make it clear that prosecution is an option for any speed above the posted limit but it would be very unusual for action to be taken below the general guideline minimum of 1(+10% + 2mph). I have heard many reports of people seeing action taken for one or two mph over the limit. However, I have seen details of many speeding offences and have never seen a case where action has been taken below the NPCC's guidelines nor have I seen any documentary evidence of one.
