BMW X1 - SE 2017 used wrong tyres - mr sean m marshall

A few days ago my dad purchased a used X1 from a franchised Vauxhall dealer. I'm very unimpressed with the standard of the car however he went against my advice and purchased it.

He had confirmed via email that it was fitted with run flat tyres, however this is not the case. He is elderly and health problems so was an important feature. It has 3 X Turanza T001I They even stated the manager had double checked. They even fitted a new HyFly HF805 tyre onto the car which has a invoice value of £40. I've tried to find if this is a suitable tyre, regardless of it not being run flat. The car was over £15K and full market value.

Since recommended runflats seem to run at around £150 a corner any suggestions on what to do?

Contact the dealer to inform them that you have bought a car “not as described “ . Give them the opportunity to fit the correct tyres , otherwise you want to return the car for a full refund under the consumer rights act.

If he has an email from the dealer confirming the car has runflat tyres, and the car does not have runflats, the dealer has misrepresented the car and needs to either fit the correct tyres at their expense, or refund part of the purchase price to allow your dad to fit the correct tyres.

Contact the MD at that branch of the dealer (not the salesman who sold the car, the MD) and tell them that unless they arrange to fit runflats of the correct spec at their expense (or refund to your dad the cost of fitting the correct tyres - get a quote for this) within 14 days, you will go ahead and do it yourself, then sue them for the costs via the Small Claims Court. Point out that the dealer said via email that the car had runflats, and it doesn't, which is clear misrepresentation.

Then put the same in a letter which you send by registered post to the MD at the dealer. Keep a copy of the letter and attach the post receipt to the letter. This is evidence that you use if you need to proceed to Small Claims.

Are you sure the car was originally fitted with run flats . ? Not all models have them .

We looked at the X1 before we bought another Superb. We were looking at the X-Line 2.0i and that certainly had non-runflat tyres but the spare was an option. Fitted under the boot floor.
