BMW 520 - Dispute with BMW - RV1790

Hi All,

I'm just looking for some opinions/advice on the following situation regarding my wifes car (66 plate 520)-

Coming up for 2 years ago, she got rear-ended at a roundabout. All repairs carried out under other persons insurance at local BMW dealer. No problem. Fast forward to approx 6 weeks ago. The car cuts out completely in outside lane of motorway while wife is driving to work. Eventually car recovered back to local BMW dealer. Turns out the car has cut out because two of the control units in the wheel well of the boot have been damaged by water, and there is a pile of water in the boot - although this is only evident on lifting the carpet etc.

We are told by dealer that this water leak is the fault of wear and tear on the boot seal / we have just been unlucky. And absolutely not the fault of the dealer for not properly repairing the accident damage. We don't accept this and leave. Forward another couple of weeks and now impossible to get anything done due to virus situation.

Feels completely like garage are just trying to avoid taking any responsibility. If BMW build quality was so poor to allow this sort of thing to happen then surely garages would be full of cars having this fault. The only thing I can come up with is that the accident has buckled/misaligned something that has not been noticed when getting repaired. And that that has allowed a very small leak, which has eventually resulted in the problem we have now.

Any thoughts on this situation most welcome

Spare wheel wells generally have a drain at the bottom of the well, usually a sort of rubber plenum valve, it's worth checking they are clear on a yearly basis when you give the boot it's annual vacuum out.

Boot seal failure on a 3 year old BMW . Don’t think so . Hopefully if the car had an approved Bodyshop repair , and will be covered for 5 years warranty under the Pas 125 quality control. Get in touch with your insurance company .

Exactly. I think that's nonsense. Already been in touch with Insurance co, but they want an independent inspection (AA or suchlike), which seems impossible to get at the moment.

Get BMW customer services involved and bypass the dealer. It’s highly unlikely a manufacturing fault. I always advise offloading a car if it’s had any moderate to substantial accident damage as they’re never right again. From paint that flakes early to water ingress and poor panel fit, I don’t like the bulk of the accident damage repairs I’ve seen in my life.

Not bad, pretty much rear bumper with associated bits and pieces - still have repair estimate

Yep, had a first pass at BMW Customer Service as well. They are currently taking the line of saying they have to go with what the dealer says. I suspect this is just their first line of defence as it were, so will continue to pursue this.

Car is on a 4 year lease that is nearly up, and we were going to just keep it, but not after this fiasco.

My 2008 Volvo v70 had a nasty front end smack in 2016, almost wriitten off but eventually repaired...took ages but came back immaculate and I've had no problems. Shows that different people have different experiences with body repairs.

From your account I would assume that you must discuss with the BMW dealer, who will have had the repair done by their preferred bodyshop. I would guess the rear of the car may have been slightly distorted in the collision, or possibly a hidden seam has been sprung.

Yes, I think it must be something like this that has gone unnoticed when repaired. And the whole point of taking to local BMW for repair was to ensure there were no issues when it came to end of lease period. (That went well).
