Just after some advice.

Had a near miss on the way home from work today. Narrowly avoided by my quick reactions.

Was heading up a hill at the 20mph speed limit coming to a cross roads where I had right if way. Van in other lane was indicating right and waiting for me to pass so he could continue with his manoeuvr, car waiting at the junction is on my left just pulls out and I have to hit the breaks hard and swerve to avoid hitting it.

I pulled over and so did the third party I'd nearly hit. (I thought at first I had made contact with the car)

I got out and there was no damage to either vehicle. I approved the other vehicle and the lady driving immediately said it was my fault. I said how can it be I had right of way as I was on the main road and she was coming from the side road and it is clearly marked give way.

I took a photo of her number plate (this is in an area of SE London that is known for crash for cash and no insurance ect). At this point she speeds off nearly hitting my car again and then nearly hitting another vehicle.

The reason I wand advice is due to the area being known for crash for cash ect. Do I phone my insurance to preempt a possible false claim or do I just ignore it?

I had something similar in a car park where my dash cam filmed a car reversing toward mine, and the lady got out and claimed i had caused a huge amount of damage to her car. I said that it was on film, ..

end of story..

I think the point is that there might be a fraudulent attempt to claim. If that seems like a possibility then a word with the insurer is probably a good idea.

Sounds like crash for cash. It sounds from your description that she wanted you to hit her, and you spooked her by photographing her car. Have you got the van driver's details in case anything further happens - although that seems unlikely given there was no contact.

Even if this was an attempted prang, it may be better to stay below the parapet in case you are suspected of dubious motives yourself. If no damage done, wait and see.

The relevant traffic dept of the police trying to nick these people used to have a dedicated phone number to call if you were the victim of a crash for cash scam, this might still be the case, if so maybe a phone call to that number if you can find it giving them as much detail as possible, only reason i know this is there was a poster from the old bill pinned up in the traffic office at one time, as i recall the poster stressed phoning asap.

The reg number you provide them might produce a name already known, can't do any harm.

There is nothing about "right of way" in the current UK highway code - am I missing something? Has the UK law changed?

Thanks everyone shall take a look at the link. Unfortunately the van driver didn't stop along with no other witness. I keep saying I should get a dash cam. This has prompted me further that they are a good idea I shall be investing in.

We do know what it means but plenty of drivers do think it means they have the right of way.

Yes we do all know what it means. It means I was on the main road and the other vehicle pulled out from the junction where they were suposed to obey a give way sign.

So do we.The OP meant that he had priority over the other vehicle. Right of way simply means that the car is allowed to pass.

I’ve had a couple of probable cash for cash incidents, one reported to the police along with supporting video. They make a note of the incident in case something similar happens again and an accident results.

Yes do get a dashcam. It saved my NCB last Christmas.

If one driver has to "give way" it is implicit that the other driver has a right of way.
