Hi guys, ok some time ago I was involved in a motor accident, I sustained minor injuries wich in time became worse, Long story short I claimed for whiplash and was advised to attend physio, over time I had 8 sessions. Time passed and eventually the insurance company admitted liability and I was offered £2200 wich I was fairly happy with, Three weeks later I received a payment for £1100 , I was somewhat confused. They gave me the following rundown, £550 for their 25% fee, £485 for physio, and £65 for other charges,. I was under the impression the physio was free and I’m really confused as to wether I’ve been took for a ride . Let’s know what you think, before I decide what to do next. Thankyou so much.

Sounds like you went with one of the parasite 'where there's blame, there's a claim' companies.

Their contract terms and conditions will have made it perfectly clear that they took a 25% fee, and the amount of compensation is designed to get you physio, etc. to help with recovery - so yes, it's perfectly valid that they pay the physio bill out of your claim.

I suspect the only lesson from this, apart from avoiding no win/no fee sharks, is to make sure you get everything in writing and have it explained if you don't understand.

The fee should be no surprise as presumably you signed up to such a thing. Neither am I surprised that physio was paid for, even if done through NHS. IIRC the NHS have a compensation recovery process for cases like this. If the NWNF shysters failed to provide full and accurate information then you might have some comeback through their complaints process or, assuming they're solicitors, through the Legal Ombudsman or, less likely, the Solicitors Regulation Authority.

OTOH at least you were still allowed £2200:

The maths sounds about right to me, given that you have clearly had a claims management company act on your behalf.

I'm not sure why you expected the physiotherapy to be free. It might have been free to you had you gone to your GP independently, but as soon as you're in the area of a legal claim against another driver and his insurance company it's not a free NHS matter any more and the therapist needs to be paid by someone.

Anyway, you did not pay for your physiotherapy - the other driver's insurance company did. You haven't lost any money, have you? You didn't expect to make a profit from your claim, surely?

Ok guys, things are a lot clearer now it was just a case of not knowing how things actually pan out and everyone and their dog is a legal expert when talking about it to friends and they told me that the physio would be taken care of by the drivers insurance company and therefore not deducted from my initial offer. So thanks to everyone who took time out to advise me and it was so helpful in putting my mind at rest. Thanks guys and I’ll certainly recommend this forum to any future accident victims or any further questions about other issues.

I claimed for whiplash many years ago. Pain in neck which developed into a very stiff neck - distinct lack of movement & pain 6 months later. 3 x Physio & I was fixed apart from neck pain solved by paracetamol.

On eve of court case 3rd party insurer caved

£4,200 for my problems, £980 for car repair, £1800 lawyer's fee, court fees, £400 for Dr's assessment x 2 (12 months apart, £180 for physio.

I received the full £4200, all the other fees were paid directly by the 3rd party insurer or paid to solicitor who paid the Dr.

Now that's what I find confusing. FB - you got £4200 for what, exactly? The damage to your car, legal fees and medical fees were all paid for by the other driver's insurance, which seems exactly as it should be - to "make you whole" (i.e. put you back to where you were before the accident).

Why did you get an additional £4200? Or am I missing something?

Whiplash £3500 + £200 for poor service from MB dealership & £500 3rd party insurer for poor service.

Complicated claim - woman puts boyfriend's car in for repair. Signs she is driving on her own insurance. She hits a car, that hits me at red lights. MB say they have no liability as they have a signed waiver until my lawyer said that allowing a car on the road without insurance was a criminal offence. After 6 mths garage gives insurance details to my lawyer. Driver of the hire car refused to reply to lawyer's letters or phone calls ("Shady businessman" who return lawyer's letters as not known) - the court summons for the GF made them remember!

Both the car that caused the accident & the 3rd party that hit me were with the same insurer - MB garage was a commercial policy dealing through a Leeds office. The car that hit me was a privately owned car with their claim being handled in Glasgow. Same company but neither claims office would agree to pay up in 12 mths. Court day was another 12 months when the insurer caved in at last minute.

Insurer said they had problems with the driver etc etc - my lawyer said that is your problem & you have caused worry & delay for my client as your company was paying whether it was Glasgow claims office or Leeds - pay up & sort your paperwork internally).

I sent the lawyer a bottle of malt for sticking it out.
