I hope you can help.

Went to garage (franchise main dealer type). They didn't have anything I liked, but had found a car at another franchise. I paid £250 deposit for them to bring it down.

Car arrives, went to see it, not at all as the dealer described, some functions missing USB etc) loads of scratches and chips. Bonnet/grill was raised Son one side, big dent in back. Stank of smoke inside and was absolutely filthy inside.

I say to dealer I'm not happy, and didn't want it. Dealer promises to get everything fixed, all scratches polished out, interior cleaned etc. So I agree, pay a furtherv1250v deposit, very reticently to sign finance for car and take it under the proviso that I'll be bringing back 3 days later to get fixed at workshops etc. I get dealer and his boss (said he was his boss but unsure) to sign the paperwork with the major works to carry out. Dealer told me to leave a list of everything that was wrong in the car and that he would fix /address it. They give me courtesy car.

So, 3 weeks later after much chasing by me, they say car is ready. We go in, and can immediately see that they haven't done anything about the scratches, so I say it's not ready and that the salesman hadn't fulfilled his part if the agreement.. Dealer and his boss then phone and text to say it is ready, that they have spent £950 on repairing the car and that they were not going to spend any more money.

I never would have agreed to the deal if they had said that it wouldn't be fixed. So I contact finance company (already one payment out)and tell them what's happened. they are quite helpful but say they are going to send an assessor out. this doesn't seem to make sense as the assessor was not there for the I initial sales discussions.. .So, sorry for the essay, what would be your advice, and where do you think Istand legally??I've hadthe car for 3days sincethe 8th March..

You are entitled to reject the vehicle as the preparation work has not been done or completed satisfactorily, but you will have to continue paying any finance.

You send a recorded delivey letter to both the Dealer Principle and the Finance Company notifying them of your rejection.

Whether the dealership folds and completes the work or fights the rejection cannot be answered.

Under no circumstances stop paying the finance, even if you cannot drive the car. Perhaps phone trading standards for advice, or Citizens Advice.

I'd reject the car even if the dealership caves in with more promises of rectification work. It sounds an absolute shed, has clearly been abused and has a high chance of becoming an expensive liability before you've finished paying it off. Presumably it'll be an ill-treated ex hire or fleet machine that the decent dealers wouldn't touch, and they've picked up for peanuts at auction. What they've allegedly spent on it is absolutely not your concern, and their attitude stinks.

My current car was obviously an ex-hire. They were everywhere, particularly at main dealers. Presumably because a new, uplifted version was available. I wouldn't discount an ex-hire, at least you know it's been decently run-in.

OP doesn't say how old the car is, but most nearly new Astras will be ex hire. Mine was and it is absolutely fine.

Thanks all, it's a 2016 plate so not old.

Dealership refusing to accept rejection, going to be tricky as it's basically salesmanship word against ours..

I assume you have a copy of this signed paperwork.

You may have to threaten the small claims court.

But then you have to hope he has money when the balifs call on him, assuming you win at court, which I think you would.

As a rule, once someone has your money you can forget all the promises made right up until the second you handed it over.

We've all been caught like this at some point and car sales is typical of the cheating class, they will tell you anything to get you to sign up, honourable exceptions are few and far between.

As for a heavily smoked and generally abused car, there was no way they were going to repaint the thing and short of replacing the entire interior that smoke stench will never be completely removed.

No, he can't because there is no evidence it is unfit and the buyer inspected and then still purchased the goods which trumps most descriptions unless it was something which would not be apparent on inspection.

What is in dispute is a contract for the seller to carry out other work post-sale. However, this was apparently verbal so open to iterpretation.

Unless you have proof of what was promised then you’ve no hope here other than appealing to the dealers sense of decency. For others reading this please never sign on the dotted line for a car you’re not happy with, dealers can’t turn a tatty car into a good one no matter what they tell you so walk away and find another. In this case it was an Astra, a model readily available almost anywhere.

As SLO76 says you can't reject something on cosmetic issues if you had a chance to inspect the goods.

You need some proper evidence as to what work was agreed to be done and to what standard. Otherwise it is your word v theirs.
