Accident - Insurance Expired - mannguy

I very carelessly allowed my car insurance to expire and then a month later I caused a collision, only a minor one but unfortunately the young lady driver suffered some injuries and has loss of earnings expenses and also damage to her car.

As I had no insurance cover and don't have much money saved, she has told me she will be suing me for damages. I know there is the motor insurance bureau but I'm not sure how that works or if they would assist. Does she need to be suing me?

How much is being claimed? Are police involved too re criminal issues of driving uninsured?

If you are genuinely 'potless' there's no point in her suing; court judgements do not get blood from stones. If however you have assets such as a car or equity in your home then a judgement can be enforced by bailiff warrants or a charging order. If she goes to the MIB and gets a payment they will come after you too. YOU were uninsured and the whole responsibilirty for that and the consequences rests on YOUR shoulders.

As Rob says you need legal advice and, while you might be lucky and get a free 20 mins or so help with basics you're going to have to pay for it.

Your local CAB may be able to help walk you through principles but are not likely to be funded to give full legal advice.

Thanks for your reply, I'm not actually 'potless' though I just don't have a lot saved to try and offer a settlement. She is aware of this so I'm assuming that is why she has told me she will be suing me. I'm not sure of the amount, it was only a minor collision and her injury (neck) didn't seem too serious though of course I can't be sure of that. If it is does turn out to be more than minor, I'm aware that together with her other expenses she could end up suing me for quite a substantial amount.

So at the moment I am thinking it's likely that she will sue me for damages. If so. do you know if I will have the opportunity to make a payment arrangement to cover her damages?

I realise that I have been extremely careless and that I only have myself to blame, I will take legal advice of course, but this does seem so much in her favour and I know that one way or another I'll have to pay her.

From your point of view, it probably does; from her point of view, probably not. But this is why you do need legal advice to ensure that a resolution of the matter (whether through a court of law or not) is fair to all concerned.

What you will want to avoid is having to pay an inflated claim for a neck injury, or for any other injuries that aren't genuine.

Sorry to rub salt and all that - but one does have to wonder how your insurance ran out without your noticing or receiving a reminder (I seem to get two of these). You must take steps to ensure it doesn't happen again. That's probably obvious.

Thanks for your reply, I'm sure you are right that she will not see this being in her favour, what I really meant was that she will at least have a very good chance of receiving her compensation.

Without going into too much detail, it was around where my post was being deliverd to so did not receive reminders. However I know I have been extremely careless and will now have to face up to the situation I am in.

I will seek some legal rep..

She cannot go to the MIB if she has comprehensive insurance (certainly not for the damage to her car, anyway).

But Mannguy already knows all this as he has been given the same advice on another forum
