hyundai getz 1300 petrol - whining noise in 1st gear - superad

Hi all, my Getz makes a shunning noise in first gear. It doesn't go away when the clutch is used. It had the gearbox taken out a while ago when the ring gear was replaced. The oil was changed in the GB and the gears are stiff when cold. Could the oil be the problem, if so I will get the oil changed?

Stiff gear imply that the clutch is not clearing properly and whining a beaing issue
