I purchased the following vehicle from Arnold Clark, Nissan, Perth, Dunkeld Road, Perth, PH1 3XJ

When fitting a new tow bar, the engineer at my local garage identified the following :-

The vehicle had previously been fitted with a tow bar....the tow bar socket was in a plastic bag taped to the underside of the vehicle and the left and right tow bar anchors were still in situ.

When this tow bar was removed the original integral cross member was not re installed.

This left the rear of the vehicle without support and in an unsafe, unprotected condition in the event of a rear shunt /collision.

I am concerned that this vehicle was not properly checked prior to sale and was released to me in an unsafe condition.

I would appreciate it if any one could give me advice on my next srep!

Discuss with the sales manager where you bought the car and suggest that they pay for your towbar to reinstate the correct chassis integrity.

It's possible that a previous owner had removed the towbar, without reinstalling the cross member, before the car was traded-in but that's no excuse for the dealer selling the car with compromised chassis integrity.

Does the new tow bar allow the OE cross member to stay in place or does it substitute.

To be fair to the garage, it's not really something they would be likely to notice, a main dealer maybe would have noticed it if they'd put it up on a ramp but no guarantee.

If the cross member is still required with the new towbar contact the dealer ask them to get one in and fit if for you.

Getting AC garage to fix something after you have paid them..............a challenge IMHO.

Remember that under Sect 75 Road Traffic Act 1988 it is an offence to sell a vehicle not in roadworthy condition.

You bought from a dealer the car you bought is not roadworthy

The Road Traffic Act (The Road Traffic Order in Northern Ireland) makes it illegal for anyone to sell a car that is not roadworthy. This applies equally to private sellers and car dealers. Anyone who sells an unroadworthy car may be prosecuted and fined £5000. If you are found driving an unroadworthy car, you can also get points on your driving licence, and even be fined.

If you've been sold an unroadworthy car, you can get the seller to put the problem right. You can also report them to Trading Standards, who may take action against them.

The previous owner had removed the tow-bar you could see the cut-out of the rear bumper and the socket had been up into plastic bag and taped up it was hanging down below the bumper.
