I have received a request for information to identify the driver of my vehicle. It was alleged that I was using a hand held mobile phone at the time of the incident. I have no recollection of using my mobile at the time. I have been asked to supply my data which I will do but there has been no proof supplied other than the letter requesting my identity. What proof is needed? Can I challenge any proof supplied? Do they need to provide any proof or is it a case of guilty until proved innocent? I will be requesting any data regarding any calls received from my mobile network.

The police have the right for you to declare who was driving the car at the time of the alleged offence. Once they have done that I suspect they have video evidence of a mobile device being used. Be advised that it is an offence not to give the police the required information and the excuse that you " can't remember" who was driving will not be accepted and you will probably be charged with "obstruction".

Under S172 of the Road Traffic Act, the police can require that the registered owner of a vehicle identifies the driver of the vehicle at a particular place/time so that they can START action against the driver - failure to comply with the S172 request within 28 days will render the registered owner liable to proceedings themselves which will have higher penalties than the originally alleged offence.

Best to comply with the S172 demand and then defend any subsequent allegation/.

Does the OP habitually, or ever, use their mobile 'phone when driving?

If so, then I think they've no defence.
