hi was stopped buy vosa last week the police was there as well any how to cut a long story short went to the back of my van to talk with the police offiice came back round and found the vosa office reading my private diary he must of went in and searched my van i have now found out the have no right to go search my van as anyone else have this happen to them i have went to vosa and the police to complain but dont seem to be getting anywhere any advice would be great thanks

Write a formal letter of complaint to Vosa, send recorded delivery, and ask for an explanation of why the officer was looking at your diary which was unrelated to your work, was it your van, is there a tachograph fitted in any form? was it loaded, empty, why wre you stpped by plod, etc.He should in no way enter your vehicle without informing you of the reason beforehand, ie: overloaded or possible alleged visible defects or to check vin number. Even then, you are allowed to watch what he does.

They were possibly looking through the diary to confirm any details the OP gave eg that he was on holiday on certain dates.

If a van's fitted with a tacho, one of the acceptable forms of recording why there's a gap for a few days or more on the tacho is an upto date diary recording the dates of a holiday or failing that they like a letter from the employer confirming the driver was on holiday on the specified days.

If it's anything like the London check points they set up for joint ventures between VOSA and the Police they will be targeting commercial vehicles whether they be tacho or not.

poilce was pulling all van and trucks in was a big setup with poilce vosa etc there was about 10 poilce officers there so why did one of them not search my van not a jumped up vosa officer playing as a poilce officer there no tacho yes van is mine

How do we know you have not a got beef against them and just looking to cause trouble? Traffic Police and VOSA must be dealing with difficult individuals constantly and see it all the time. What was in the diary you didnt want him to see and why didnt you want him in your cab? Or was it that they were just inconveniencing you?

Maybe VOSA can play the `suss` card and say they were suspicious and looking for something to support or disprove something they wanted to know or that you had told them.

VOSA like the H&SE are a neccesary evil and my own experience is that if you are fine with them and they can see you are not taking the ++++ they will be fine with you in much the same way as the Police are. But.......they are just doing their job and in the long run its for the benefit of every road user. Mess them about and give them a hard time and like the Police they will likely drop on you from a great height in every way possible and from the tone of your comments your opinion of them is not one of respect.

Write to them and complain,I would guess the best you will get is a letter of explaination and perhaps an appolgy. To me it wouldnt be worth the effort but if it makes you feel all warm and fuzzy go for it.
