I purchased a 2 year old 19,000 mile car from a large car supermarket 3 weeks ago and drove it 50 miles home. The car would then not start (after 1 hour of ownership) and was towed to the local main dealer and has been there ever since. The main dealer believe the problem is contaminated fuel, but can not confirm whether this was the small amount of fuel in the car when purchased or the fuel I put in immediately after purchase (I put in the correct fuel and the receipt to prove it). They now say it is not a warranty issue due to it being a result of outside interference and so want to charge me to get the car back (saying all they want to do is repair the car and get the money, washing their hands of the issue) . I have been pushing the car supermarket to exchange/refund me for the car as it was not fit for purpose, but feel they may try to deflect the situation on to the petrol station (who I believe are unaware of the issue). I do not want to pay the dealer as I feel I may end up out of pocket by the £1700 repair bill through no fault of my own as the place of purchase and the fuel company end up in a stalemate with neither accepting liability. Am I correct in saying the liability is with the place I bought it (and I should just insist on my money back) and the onus is on them to prove someone else is liable and reclaim damages if they can? Are cars in this area who filled up at the same station having trouble if not things could prove to be a little difficult, if the wrong fuel is found in your car due to the tank at the station being filled incorrectly it its the stations fault then they should pick up the bill, I assume you have contacted them

Get a solicitor on the case as soon as possible, don't muck about, show them that you mean business, they sold you a wrongun, it's up to the seller to sort it out.

When you are running a business the receipt of a solicitors letters tends to concentrate minds and get passed up the management chain to the level where something gets done about it, rather than the pass-the-parcel attitude amongst the pond-life at the bottom.

Collos - My Dad, who dropped me at the place to buy my car filled up (different pump but same unleaded fuel) immediately before me and had no problems in his Focus. Have not contacted the station yet - the dealer only told me yesterday afternoon it was fuel contamination (not covered themselves in glory taking that long to diagnose). Think my preference is to push the place I bought it to prove it wasn't their fault rather than putting myself in the middle of 3 way scrap.

Not sure they're telling porkies, just think they are all saying not me:

Repairers are simply saying, it's not warranty so we'll fix it and get you your car back and take the money and wash our hands with it. Also saying we aren't going to help you determine who the issue lies with. In other words "not our problem"

Supermarket are saying, we are not going to back (and nor are you) it should get fixed under warranty or alternatively you can get money back from petrol station. In other words "not our problem".

Petrol station are likely to say "prove it" especially as the supermarket sent all cars out on fumes and direct people to that station, if there was a problem they would be having more complaints than just 1. Also my dad used the fuel and it was fine. When I've heard about this kind of thing before everyone has a problem and not are 50 miles but immediately.

Leaving me wit no car, having done nothing wrong between rock and hard place, whilst big companies fight it out (or rather ignore it because it's easier, they are suffering after all).

You need more information. It sounds like it will get tedious, so as above, a decent solicitor's time will be money well spent. i wouldn't be happy in your situation but i reckon the law's on your side here ultimately.
