Hi All,

I bought a 2009 Golf last week that was supposed to be a one owner car with full VW service history.

I have now found out that the dealer bought the car nearly 2 years ago and has been using it.

Then to completely ruin my purchase I have a found out the first owner was using a garage to stamp the service book using an old VW stamp which means my car has no dealer history.

I paid quite a premium because of it's 1 owner and FVWSH so feel cheated.

I have contacted the dealer requesting a full refund but as of yet he has declined.

Now the service book is fraud to me, I am not blaming the dealer really as he has obviously taken it at face value but the owning/driving the car for nearly 2 years without registering has got to be an offence...hasn't it?

Any advice?

It seems you (and the dealer) bought the car at face value, and then did research which revealed facts you would rather not have found out. It is a bit much for a dealer to use a car for two years, but it isn't that different from using it as a demo, or a hire car for that matter. The real question is whether it has suffered as a consequence.

I would guess that it would be hard to make any claim of 'fraud' stick effectively. Dealers commonly run used cars without changing ownership, but not often for that long.

A 'FSH' consisting only of service stamps is an easy target for this kind of 'fraud'. Are there any bills or more valid evidence?

You bought the car from the dealer, not the previous owner.

Therefore you have no claim against the first owner.

Regarding the fraud allegation I just assumed it was the first owner but Trading Standards say that as the dealer has had it for nearly 2 years who's to say he hasn't had the book stamped? replaced the service book?
