I'm after some advice regarding driving whilst on SORN (no road tax) it slipped my mind!!

To my horror the other day (evening of Easter Sat 30th Match, 2013 ) noticed I didn't have any tax on my small motorhome whilst in South Wales (live in North Wales) It's been on SORN for the last few months. Totally slipped my mind before i left on Friday 29th it was end of March!!

As I was away from home (about 200miles away) had no log book, and Post Offices closed anyway Sat evening & Sunday & Easter Bank holiday Monday. Had no way to tax it. I taxed it straight away upon getting home (on-line) last night Monday 1st, but from 1st April.

Technically I'd driven the vehicle with no tax for 3 days in March without paying.

Problem - think I might have been spotted with an ANPR camera. Have I got a leg to stand on? Genuine, honest mistake, never done it before with any of my vehicles.

What do you think, ok maybe I'm worrying about nothing, but knowing my luck something will arrive in the post very soon! what could I do when the fine arrives?

All you can do is come clean.

There used to be a mechanism for paying back tax in circs such as this. AFAIK one obtained a form either from DVLA or the post office. A web search will presumably find the process that's applicable now.

You may consider sitting tight in the hope that they do not process your indiscretion. However you could get in first by speaking to a DVLA Office to rectify matters and pay a months back duty.

One problem you should be aware of is that in your application for the Licence was there a question for you to certify that the vehicle had not been used on a road between start of Licence and expiry of the old one?

If you said NO then there is the very serious offence of making a false statement for the issue of an Excise Licence which carries 6 months pokey.

Interesting point, as you don't need an excise licence to go to a pre-booked MOT, or (I think) to go to a place of repair for repairs and an MOT to be carried out. So answering "yes" says nothing really.

.... it certainly does if they check up on the claim and there is no record of a pre-booked test. How many Garages will risk a PCJ charge by back dating their records?

Does a pre-booked test now appear on the electronic records though? They will show when XXX123X had a MOT, whether it passed or failed and what advisories were given. Last time I drove a SORNed car to a MOT, it was years ago, and the MOT garage just kept a written diary on paper of such bookings.

Not that I'm advocating being naughty, but checking up, while possible, does seem to involve quite a bit of work, especially if the driver like me, had played everything to the book so a check would reveal no transgressions - or at least a valid use of the legislation to get an MOT. However, it would say nothing whether the car was illegally used untaxed for other journeys.

Surely it must do - pre-booked test - Pass or Fail. MOT records freely available online.

Don't think claiming he was going to a pre-booket MOT would do the OP much good. First it was over Easter when garages were mostly shut and he was 200 miles from home, pretty sure you are supposed to visit a local garage.

Once in 39 years of driving but the car was taxed, simply forgot to put the new disk in before going to work.

Some drivers think its a game, guy down ourstreet does it every 6 months when he tries to get a moth free. I report him every time. The smake should be banned.

Not condoning untaxed vehicles just pointing out that most of us have probally done it at some time or other and whether the OP made a geniune mistake or not only he knows. At least now he knows what the likely outcome is.
