So we purchased the new Renault Clio alpine esprit. Within 20 days the car started making a really bad noise that would not go away, I took it to the dealer they supplied me with a Hyundai hire car while they tried to work out what was wrong with it. 1 week later I have been told it need a full new gear box. The gear box is on back order might be 15 days possibly end of march. Because I brought the fault to their attention within the first 30 days. Can I reject the car or does it have to be rejected within 30 days. 7 days of this was the master technician trying to work out what was wrong with the car. I’m led to believe changing a clutch on an automatic hybrid is not an easy task as well. The car no longer feels new to us. A new car is also 4 month back order. Any input or advice would be appreciated.

There are better experts than me on here, but AIUI, your supplying dealer has to be given an opportunity to rectify the car before you can reject. While supplying you with alternative transport of course.

A new car that needs a gearbox doesn’t sound promising to me . With a major issue like this, you don’t need to allow the dealer any attempt to repair. Reject it straight away under the 30 days rule .

The car was taken to them within 20 day and left. They have had it since to work out the problem. The fault was brought to their attention within 20 days, however because they have had it for some time im now out of the 30 days. Is the rule as long as the major fault was brought to their attention or did I have to reject it within 30 days. Also the gearbox is going to be 3 months I’m paying for a clio driving a Hyundai.

I know if it’s out the 30 days but within 6 months I have to give them 1 chance to fix the issue however it has been with them since about 20 days of having it. The fault was brought to their attention the reason it’s out the 30 days is because of them trying to figure out what was wrong with it. Really I need to know as long as I brought it to their attention can I still reject it. I want a like for like so not a fickle refund.

If under 30 days you have automatic right to reject.

If the vehicle is financed start rejection proceedings through the finance company.

I’m no mechanic but I am led to believe a full gear box change on an automatic hybrid is no small job and would normally cost over £2000. When the car is brand new I don’t expect a major problem like this to arise

I think I’d be finding out a little more about the fault as the Clio Hybrid doesn’t have a clutch.
It uses a small electric motor to synchronise the next gear, removing the need for a clutch.

It’s the full new automatic gear box. They can’t work out what’s wrong with it so are replacing the full thing. This involves taking the full subframe down, the unit is pretty big. Seems like a big job. The master technician and Renault say they have never had this fault before. It’s the amount of work it involves and the potential 3 months wait even just to fix it.

A 23 plate car must be at least 4 months old now (registered 01 March 23 to 31 August 23) so its either been at the dealers for over 3 months if it failed in the first 20 days or you bought it used.

If its the latter you can see now why it was back on the forecourt so soon, its been rejected before.

Looks like the car is possibly a lemon.

You really need to negotiate a replacement car if you cannot reject it.

It was an order. We waited 4 months for it coming in (that was because the new clios were not released) so technically a pre order. It come into port we had it a week later. So it’s brand new. 20 days old. They are trying for us to lean towards the repair however we are paying for the top spec clio and driving a bog standard Hyundai and could be for the next 4 months. A brand new car should not have to have this big mechanical work on it. I know small faults sometimes occur but replacing the full gear box because they can’t work out what’s wrong with it.

If the car's only 20 days old, why is it a "23" registration - it must have been registered on or before 31st August, that's almost 4 months old.

If you brought it back to the dealer to have them deal with the problem, this stops the 30 day clock for the right to reject.

Section 22(6) CRA 2015:

"If the consumer requests or agrees to the repair or replacement of goods, the period mentioned in subsection (3) or (4) stops running for the length of the waiting period."

Asa it's a new car that already needs a new gearbox I'd immediately reject it and get something else as you don't know what else may be wrong with it and it's not worth the hassle when you can be shot of it.

I am due to collect my new Renault Clio hybrid very soon. Which dealer did you buy the car from? Did you get any PDI certificate to confirm that the dealer thoroughly checked the car before handing over. What’s the latest status now?

Just trying to keep myself aware.

With Renaults, the PDI isn’t done at the dealership, it’s done at the port of entry (Portbury).
The dealer has very little to do.
There should be a PDI checklist in the book pack.
