daughter went and bought a 3 year old Baleno from main dealer. 9 or 10 days later I'm in the passenger seat, boiling hot day, so I try the aircon. (Daughter knows nothing about cars - didn't know what aircon even was)

Waiting, waiting - air doesn't get any colder. So dealer failed to check it - OR forgot to tell her on the long test drive they did.

Booked in for next week to "have a look at it" while she waits. Dealer guy was reluctant to promise 100% a free remedy. Mumbled something about "depends what kind of warranty"...

I know they have to protect themselves against the possibility of the customer damagingthe equipment etc but can I assume she is entitled to get this thing put right???

Not withstanding any sort of warranty you may have consumer rights are down to what a reasonable person may expect.

Would I expect aircon to work on a 10 year old car? Probably not - I'd be pleased if it did and consider it a bonus. Would I expect it to on a 3 year old one from a main dealer? Personally I think I would and most reasonable people would. 3 years is early for an aircon failure and probably beyond expected wear and tear.

I think they should fix it and I'd press them to do so.

cheers pd. I think it's unprofessional (maybe it IS "professional") for a main dealer to forget to point out that a significant element of the car doesn't work. From memory the consumer laws are in her favour.

If less than 30 days you have right to reject the car and this may be my approach.

It only needs a previous owner who also never used aircon for it to have caused significant issues to the whole system.

As PD and Daveyjp said, tell them they either fix it or you will reject the car for having a fundamental fault that manifested itself within 2 weeks of taking ownership. No ifs, no buts.

Aircon is a major feature (and an expensive component) of cars today, and as said, on a 3-year-old car from a main dealer, you have the right to expect it works as it should.

It probably just needs re-gassing, but really it's not your problem, it's theirs. Don't take any crap from them.

I'm not sure that a failed aircon would be seen as a 'fundamental fault' making a car unfit for purpose. But I agree that it should be a fixable fault which the seller ought to put right within the time limit. It can't be unfixable, surely ?

What happens if it turns out to be a stone in the condenser? Who's tk say if it happened pre or post ownership?

Nothing is unfixable. The issue comes when fixing it means proper diagnosis, which takes time and potentially having to change some very expensive components.

Regas is easy, it may work long enough to get the car out of the workshop, but unless the fault is diagnosed the gas will disappear after a few weeks.

It may be nothing more than a leak on the filling cap valve, but it could be compressor etc.

My daughter got bitten in exactly the same way.

Really sorry bring it in and well sort it. Yes they sorted it by re-gassing. A few months down the line (when your rights are eroded) it fails again. Diagnosis was a hole in the condensor which it would have had a time of purchase.

Expensive to repair and for me if its fitted it should work even for the sake of when it comes to a private re sale. you could loose a sale or have to offer a suitable discount when by rights the expense should have been shouldered at purchase time. And a tidy profit will have been made at that time as well.

A three year old car should not need a regas unless there is an issue,

As above , if it’s out of gas, it’s got a leak . Very likely to be running on the new YF gas , which may be environmentally friendly, but is proving very difficult to maintain a leak free system .

I have current/very recent experience of successfully rejecting a 2016 Baleno and of failure of its air-con system (that wasn't what I rejected it for). I'll post more about it shortly because I think it could be useful to others.

There is stuff you need to know and do now before the 30 day time limit expires.

I think in a previous post you mentioned that the car was to be bought on finance. If so, and if it's HP or PCP, the critical points is that legally it was the finance company that supplied the car, not the car dealer (see both linked publications). The finance company has the obligations to the consumer, the dealer has none. You have no contract with the dealer. The FO says that some finance companies will wrongly try to push customers back to the dealer.

The test under the Consumer Rights Act 2015 is whether the car is of 'satisfactory quality' taking into account age, etc. - the 'satisfactory quality' that a reasonable person would expect. I would suggest that non-working a/c (for whatever reason) is clearly not satisfactory quality.

I would suggest that:

1. You do not take the car back to the dealer for them to 'have a look at'. The dealer is a third party and this may complicate and delay things.

2. Immediately contact the finance company by phone, e-mail and 'real' letter saying that the a/c is not working and the car is not of satisfactory quality. Say that you wish to exercise your rights under CRA 2015. If it's within 30 days of the contract date say that you reject the car. Give them a time (say 7 days) in which to respond. (Be prepared to encounter delay, obfuscation, and obduration).

3. Start and maintain a log of all contact with the finance company - times/dates/content of phone calls etc. This can be invaluable.

In relation to the a/c on my Baleno, I took it to a local specialist who tested and regassed it. They introduced a UV dye, and when I took it back for follow-up a week later found a leaking condenser. They said it was probably corrosion, apparently a known fault. I took it to my local Suzuki dealer. Quote £550, not covered by Suzuki Used Approved Warranty. Still within 6 months since acquisition so I put in a complaint to the finance company under CRA (they get one go at repairing it) but this was (and has proved to be) academic because I was already quite far along in the (finally successful) rejection battle.

And yes, the Baleno uses the newer more expensive and troublesome a/c gas.
