I bought a used car in mid February this year. I noticed the air conditioning was not working within three weeks and notified the dealer. Eventually they did get back to me, after a week of trying, and they asked me to get a quote as they are over a hundred miles from me.

However we have since had the lockdown. I am concerned that as time passes they could try to wiggle out of their verbal agreement to fix the problem as the sixth month period could pass before it gets sorted. I do have text conversation with the dealer in which he does say he will sort it out. What should I do next? I did by the car on a credit car so am aware they could be jointly liable. I have tried ringing recently but got no reply despite their website and auto trader site being active. Anyone in a similar position?

I am no expert in the legal aspects here, but the first thing i'd be thinking about is whether or not the a/c is just needing re-gassed. If this is the case, it isn't expensive. So to that end, how old is the car?, and is the system just not providing properly chilled air or is it not working at all?.

The other thing you could maybe try, is to get your dealer to provide something in writing that they will cover the cost of the a/c repair once you are able to get it attended to, i.e, after the lockdown.

I did get it tested and it has a leak. It's the pipe that goes to the back and it's not cheap. the rest of the system is fine I am told. I sent this info to the dealer and the lockdown happened 2 days later. They told me they would sort it when the lock down goes. My concern is if they don't and I have to fork out for the repair as it's a mobile greenhouse without aircon.I am going to put everything I writing g to them this week but am thinking the credit card company might be jointly liable. At least that is what I thought....

If it's an aluminium pipe that is leaking, then it may be possible to get a repair done until the dealer can have it back . This may be a more cost effective and quicker way of getting it fixed. Did the test identify exactly where the leak is?

Whether you have any legal right really depends on how old the car and mileage on the clock.

If it's 10 years old then a worn or corroded aircon pipe would probably be considered a reasonable thing to have failed on such a car and it would be unrealistic for a buyer to expect such a car to be perfect. If it is 2 years old then it is not something you would expect, and all points in between. You won't get anywhere with the credit card company unless this is a very new car as it is still fit for purpose, mobile greenhouse or not.

So that is the legal position. If you don't really have a legal claim you are relying on the dealer's goodwill and sticking to their word. At the moment you have no real reason to think they won't.

I don't know where you got your advice from on section 75 liability but it's wrong.

The description is just "goods" it doesn't specify new or used.

All you have to do is to have paid more than £100 for the item, even a part payment is covered.

Going on the reviews I am reasonably confident he will sort it. I don't mind a repair as the pipe is a main dealer part and not cheap but I did mention I wanted working aircon when I looked at it. I've had a big mpv with no aircon before and its not fun. I will update if and when I get a response.

Regardjngs section 75 I bought a picasso a few years ago on credit card. That was 10 years old and a bag of rubbish with major electrical gremlins rendering it useless at random intervals. Before GDPR I wrote to the previous owner to find out he'd thrown lots of money at it and had given up. The dealer told me to go away so I used section 75 and the credit card company paid out and took it away. It's still on the road going by the dvla checker!.

If the dealer doesn't sort it I guess it will be section 75 again.... Just a hassle really but at least the rest of it is great.

There is a big difference between a car which simply doesn't go and one with leaking aircon.

In this case, I think you'll be OK, the dealer sounds sensible and not doing non-essential work in the current period is a policy most are using.
