This is a long one so please bear with me...

In July 2018 my vehicle suffered an issue as what can only be described as an exploding sunroof. We were travelling on the M40 in busy traffic when a gunshot sound occurred inside the cabin, and myself and partner were covered in broken glass and cuts. Not only was the sound extremely disorienting but the fact we had glass showering from above us into our eyes and mouth and down our clothes, somehow we managed to pull over 2 lanes of traffic to the hard shoulder. We contacted the police believing that we had had something dropped onto us, but we had not passed under any bridges.

We pulled off the motorway about a mile or so later and were able to assess the damage. The entire sunroof had exploded outwards. This was evident by the glass in the car did not constitute the amount of glass missing and no objects had entered the car and the hole was splayed outwards in several areas, not inwards as would be expected by an impact.

We had numerous cuts in our heads, our faces, on our chest and arms and hands. Further to this, we both suffered many weeks of sleepless nights, I was prescribed with anti anxiety medication and sleeping tablets as this was a terrifying incident which nearly brought our lives to an end.

The vehicle is also specially adapted to my disability and acts as home to my electric wheelchair, operated by a hoist. The car was taken to the garage for repairs leaving me without both transportation or the facilities to get out and about. Motability attempted to replace my vehicle but these were unsuitable for my needs.

I had no storage facility for my wheelchair and I was without transportation for weeks because of this and unable to do any meaningful activities which further exacerbated my mental health conditions.

We were due to go on holiday to France a few weeks after this incident. Tickets had been booked under my vehicles' details. However, we were unable to order a vignette, an emissions certificate where, without displaying in certain areas in France, could result in a fine or even the vehicle being seized. We therefore had to cancel and change our intended plans significantly as there was no guarantee when the car would be returned. It was too late by the time it had been repaired to order them.

According to Listers, they agree that the sunroof exploded, and that the glass was clearly faulty.

The vehicle was returned eventually and we gingerly took it with us. Both myself and my partner, to this day, still suffer anxiety when driving the car which in itself ruined our holiday as it is nerve racking getting into a car that nearly killed us, as well as having to change our plans significantly.

I was advised by Seat customer services that their legal team would be writing to me, as I had been advised not to accept a goodwill gesture of a meal out, due to the injuries, both psychological and physical, the severe inconvenience caused and extra expenses incurred.

It doesn't end there, as on 14 November 2018, on a trip to Banbury, I could not take my wheelchair out of the car. A screw had been lost in hoist which the garage had to remove, had not been installed again properly. The next day I took it to the company that installed the hoist and they looked it over. The Seat garage had not installed the hoist again properly which risked the warranty. Fortunately, the company (JDHC, Coventry) they still intend to honour the warranty however this, again, led to a wasted journey.

Seat legal got back to me saying they are not liable as their client only imports the vehicle and therefore they do not hold any liability, and they require the sunroof as evidence anyway (their garage took it off and, presumably, disposed of it). Do I have a claim for inconvenience, injury and mental anguish here? Frankly, I am still terrified to drive the car but I have no alternative and feel like they are covering this up.

I sympathise with you for what happened but I utterly despise this claims culture. What happened is highly unusual so I can fully understand why the firm needs to see the remains of the old sunroof as I suspect they are of the mind that something did indeed hit it. It is possible that it was faulty but these components come in batches so others would’ve went the same way and if none have you can only conclude the roof wasn’t faulty and something had impacted it, possibly when you weren’t in the car and weakened it beforehand. I am of course assuming the car hasn’t been in a serious crash and thus the body perhaps twisted?

You had an unfortunate incident but a highly unusual one, it’s something that will never happen again in your lifetime so there’s no need to be concerned about driving the car and without being able to examin the damaged roof Seat will be under no obligation to pay for any compensation especially since they did return the car in time for your trip.

If this is a car you personally own I’d push the dealer for a free service for your inconvenience especially after they messed up reinstalling the hoist but if it’s supplied under motability then this won’t be relevant and I doubt they’d be willing to offer any cash compensation.

At the end of the day cash won’t help with any anxiety you’re suffering from.

3 weeks left in warranty - BMW replaced foc, re-sprayed roof etc but it took them nearly 4 weeks to do it - sunroof on back-order.

Liability is with whoever sold the car to you. So you need to be chasing the dealer. They may well in turn chase the importer, who may chase the manufacturer, but as far as you as a consumer are concerned that's irrelevant. Chase the dealer; get legal advice (Citizens' Advice for free) and approach the problem that way.

This unfortunately what happens when toughened glass shatters, most old hand lorry drivers (i had my share of these so know the noise involved) will recall how frightening and painful it was when a full size screen shattered and blew in your face at 60mph or so, covering your face and arms in hundreds of cuts, thankfully eyes instinctively close at such moments.

I'm afraid its just one of those things, glass can and will break, if its laminated it will stay in place thankfully, toughened it will shatter into thousands of less deadly pieces, no doubt the speed and airflow involved sucked a good portion of the glass out.

They fixed it and imho that's all they needed to do, they don't know if was previously weakened by say a stone landing on the roof whilst the vehicle was parked and nor do you, it could even have been a stone hitting it at the time it went off.

Time will heal this.

Thanks everyone. I think it's probably just anger at how they have ignored me. It was an extremely stressful few weeks but, as you say, a freak accident. I will more likely than not just leave this as it is. The solicitor who advised me to refuse the gesture has subsequently decided not to take the case as well, lack of evidence. C'est la vie. The garage were outstanding though in their repair (other than the hoist). They butchered another Alhambra for its sunroof. Appreciate your responses.

Hello Tristan, what an awful experience. Fortunately no one was injured. At least now, even after some poor after sales service you are back on the road and hopefully problem free. I would never specify a sun roof and when company cars came with them I never used them at all, after a particularly horrible experience with one on a Renault. Just left them closed. IMHO they are as useful as a chocolate teapot! However you have one and have to live with that. Take my advice. Close it, Leave it closed and forget all about it. There could be many reasons for the glass breaking. Undue stress from body/ frame flexing, Stone damage causing cracking and weakening. Unlikely to be a manufacturing fault that you can identify afterwards. As stated the dealer has fixed the problem so you need to move on. If you ever order a new vehicle in the future, remember to order one without a sunroof.

You have had the car 6 over months and in that time a lot of things well out of the manufacturers control can happen to glass, that is why no manufacturer will warranty glass breakage.

But since the vehicle has been modified who can be 100% certain that the work hasn't weakened it in some way or damaged the glass, again its not the manufacturers problem.

But is it a sunroof i.e. smallish piece of glass or one of the currently fashionable glass roofs that seem to be a must have on some cars and form a majority of the car roof.

Had several glass sun roofs and never had a problem. Would never have a full glass roof, way too vulnerable and plenty of complaints about them breaking on several forums.
