I’m on 9 points, and have received a NIP for 57 in a 50. Speed Awareness course and potential hardship aside, 3 of my 9 points will lapse on 26th November. If they don’t get round to issuing a summons until after 26th November, will the summons automatically lapse, as when they check my record, I’ll only be showing 6pts, and if that is the case, will they just send me a 3 point penalty and a £100 fine?.

Sorry they work from date of offence otherwise drivers would just adjourn hearings to escape.

Have you done a speed awareness course? If so, what the date of the offence it related to?

For someone on 9 points and still not observing speed limits, I doubt that an awareness course would do any good.

Whether or not it will do any good is not the reason I asked the question. If the OP is eligible (i.e. if the offence was not committed in Scotland - where courses are not offered - and if he has not done a course for an offence committed in the three years prior to this one) he will be offered a course. He need not then worry about preparing an "Exceptional Hardship" argument.

57mph in a 50 with 9 points on his licence & he wants advice?

Drive below the speed limit (full stop)

Which, of course, helps him with his current predicament enormously.

Agreed, Middleman. People often ask for advice with problems on this forum, and even as amateurs (although people like Gerry / DVD have relevant experience which is always helpful), we should always try to be helpful, even if the problem is of someone's own making.

If it's of their own making, they will know that already, so there's no need to rub it in.

You can certainly pay for mistakes in this life and this is a prime example. Maybe at this stage we have a very contrite driver contemplating his livelihood without a licence. I don't know how mush discretion ,magistrates have but maybe if the circumstance warrant it he may not receive the ultimate censure. I only hope common sense prevails in future.

Whats wrong with suggesting the obvious.

It may be obvious to us but perhaps its not to the OP which is why he is in his current predicament.

But lets be totally honest, the OP is not the first and will not be the last.

Whats wrong with suggesting the obvious.

Because the OP did not ask for advice on how to avoid more points in the future. He was asking about his current problem and in particular whether he could avoid disqualification.

Apart from you giving him hope that a Speed Awareness course might be offered, there seems to be no other advice on your terms

Since the OP would appear to be a serial offender giving them advice about the future would appear to be a very sensible thing to do especially since they are likely to loose their license in the next few weeks.
