Hit and run advice - To Much NOx
Hi all, first time on these forums I am after some advice. My wife was hit from back by a driver yesterday. At traffic lights in a city she wasn’t familiar with. Other driver who had a child in front seat apppologised said her “brakes must have failed or something “. My wife attempted to get further details but was very shaken. The other driver said they needed to get to the side of road (middle lane of a three lane main road in rush hour). She then got in her car u turned and drove off. My wife got a registration and car make and colour only. My wife could not locate her. The wife’s car has a few grands worth of damage bumper parking sensors etc. The third part car was well crunched and look almost written off.
I checked the vehicle taxed no MOT.
Wife phoned police got a road traffic incident number. said they put a report out to look for them.
As expected our insurance company said vehicle has no current insurance.
We will be liable for our excess and it will go as a claim against us should the third party not be traced.
We have submitted a claim to MIB and filled in a V888 for DBLA.

I don’t have any faith in insurance company or police pushing for this, meaning we are stuck with a excess we won’t get back and a unresolved claim against us. Is there anything else we can do? Report it as a crime instead of a road traffic incident?

You could sue the owner in the small claims court but that doesn't mean you would see the money if the owner/driver has no assets.

That is providing they can be traced. That is my main concern. If the car is taxed it has a registered owner so I would hope some level of investigation would be conducted. My fear is no one will do anything at police level or insurance unless I can push it some way so they are identified.

Unfortunately I suspect investigations will not trace the keeper (false name?). Even if they did chances of them being able to satisfy a judgement for thousands are nugatory. I'm afraid your going to have to claim on your own insurance/MIB and take the rap for excess NCDloss etc.

Manchester. Whole insurance system on hit and run appears loaded against the victim. Fully comprehensive is far from it. Seems quite easy to get away with not insuring a vehicle despite databases and all cctv number plate recognition systems around.

DVLA and local plod have both been advised weeks ago of an untaxed, un-MOT'd and presumably uninsured vehicle parked on a public road. No action from either yet.

Many years ago, whilst driving through a certain south london area, and in conversation with a Government Minister, I was told that Police/Council/DVLA didnt follow up on the untaxed cars parked in the area in order not to upset local sensitivities

Update on this managed to get last legal owners from DVLA sent this to insurance company as they had failed to do anything. MIB visited for assessment. Reported incident to which legal team for advice as we get legal advice as a subscriber. Bizarrely over a month after incident we had not had car fixed due to excess and no courtesy car. Insurance company phones claims the third party was actually insured and wavered excess and offered a good hire car while repairs carried out. Yet third party car s still registered no MOT? Currently getting car fixed and have a high spec hire car paid for. Strange set of circumstances can’t work it out?

Terrible incident all round NOx. At least there is some positive movement. However never expect an insurance company to go in to bat for you. They will look after number one and take the easiest option to process the claim and lump you with the blame, excess and the loaded future premium. Seems you have done a fair bit of legwork yourself and this is usually the only way forward. Unless there is an injury officialdom doesn't want to know. Good luck with the rest of process.

Yep wife won’t let go of these issues. Offered a paltry sum for inconvenience and customer care. Not accepted it. Get the motor fixed and see if we want to proceed further.
