Why is our insurer offering less than what our car is worth?
My daughter's car was written off by a workman's gas bottle that rolled off the pavement under her car. They have public liability insurance and have admitted liability. I have said she should claim for what the car has cost her plus any expenses she has incurred. She has owned it for a year and paid £11,000 for it. Her car insurance company say it's only worth £6500. Is that right?

What your daughter paid for the vehicle is not necessarily what it is worth. Is the car new or secondhand? If it was new, she may be entitled to a new vehicle replacement. If it was secondhand, she is entitled to the market value at the point of loss. If she has gone through her own insurer, they cannot act in conflict to her lawful entitlement under the "tort" against her. Ask the her insurer to provide evidence of how they have valued the vehicle, ask for a full copy of their audatex report with screen prints of both Glass and CAP guides.
