The garage wrote off my car - do they have to replace it to the same standard as mine?

I took my car for its MoT and while they had my car in the garage they managed to write it off. What if their insurance company offer me the book price and it's not enough to replace to the same standard as my car? Does the garage have to replace my car to the same standard as the one I took to them?

Have you claimed of the garage's insurance or your own? If you are going through theirs, I would recommend not dealing with them directly, as the injured party you have different entitlements under Tort Law than you do through claiming via your own insurer under contract. You can always speak to them first, and if not happy use a claims management company, a solicitor or your own insurer. If your car is the normal run of the mill type of vehicle, you should not have any issues. If it's particularly unique, then you may. You do not need to accept the valuation give, you can always dispute it. It pays to carry out your research prior so you can see if you are being treated fairly or not. Your contract of insurance will state, "market value" one by which you as the owner can replace the vehicle for one of the same make model year specification mileage and condition as to the one you had. Make sure you can.
