My new car was damaged and repaired before delivery - can I reject it?

My new car was due to be delivered today. I received a call yesterday afternoon to say that it would not be delivered as it was damaged by the car valeter. I don't know the extent of the damage. It is now to be delivered next week, but I am not very happy because I was expecting a new car and now I will be getting a repaired car. Am I entitled to reject the car and demand that they supply me with a completely new car or cancel the contract without penalty?

Yes, you are theoretically entitled to reject it under the Consumer Rights Act 2015. The dealer will probably resist, though, and, because there is no High Court case law on the CRA 2015, it might have to go to (expensive) full County Court. See: www.honestjohn.co.uk/faq/consumer-rights/
