Can I reject my Vauxhall Astra Estate?
You say "the supplier must be given three chances to rectify the fault for which the goods are rejected and must have failed to do so". Does this have to be the same fault every time? I've taken an Astra Estate 1.3CDTi back for repair three times in three weeks, and it now needs to go back again. The dealer made much of their 99-point inspection and service, and the 90-day warranty. They'd also promised to change the cam belt before I took the car.
First time was the cam chain and an oil leak (power loss) on the home from collecting it, which took five days to repair. Clearly they hadn't done a smoke check or adequate engine performance test, as indicated in their inspection booklet. They dumped the car on my drive while I was at work. I find it inconceivable that they could have driven it to Preston, as they claim, without being aware that the turbo was worn out and whistling. Secondly, they changed the exhaust back box (which was making a whistling noise), which was another five days' repair. They dumped the car on my drive again. Third time was the turbo and another oil leak (same whistling) - again five days' repair, and they declined to give me a courtesy car. Each time I had the car long enough to do a road test and arrange to get it back to them - shouldn't they have tested it thoroughly?
It's still leaking oil, and I believe fluid (probably diesel) is leaking into the oil. I paid £4385 and have been without use of the car for three weeks. I'd like a reliable working car, but I've no confidence in their service, which appears to be the minimum they think they can get away with, or in the car, which they've handed over as repaired three times. Obviously this could be the subject of litigation, so please don't publish anything which would prejudice that.
