Faulty gearbox on C-Class

Two years ago I purchased an "Approved Used" Mercedes C180 for my wife, the vehicle less than one year old, approx. 12,000 miles. On multiple occasions through following two years (between 5 and 10 I estimate) the car has been into the dealer to remedy a problem with the gearbox (snatching gears) which occurs when the car is cold.

The fault has never been remedied despite me demonstrating it to technicians when the car is cold, the last adjustments that they made to the gearbox actually made the car feel worse.

I am now faced with a situation whereby the car's warranty expired yesterday and any future repairs will only be dealt with on a goodwill basis (I have confirmed this with Mercedes-Benz UK).

How on earth can this be reasonable or even legal when I have been fulfilling my obligations within the warranty period by giving the dealer ample opportunity to remedy a mutually identified fault?

Presumably automatic? Could be a symptom of moisture in the transmission fluid. Possibly curable by a change of transmission fluid. The problem is that it's such a minor irritation the dealer can't justify changing the transmission completely.

You could suggest to him that because you bought the car from him and because he never fixed it, you are entitled to a fix under Clegg v Olle Andersson 2003 House of Lords and if the dealer cannot fix it you will take the car tyo a member of www.fedauto.co.uk and if he can fix it sue the dealer to foot the bill.
