Problems with reverse on VW Up ASG

My in-laws have a 63 reg VW Up ASG which has only done 6,600 miles. It had a software update about 9 months ago however, 6 months ago it developed a problem where reverse won't engage when cold. It takes a number of attempts moving from drive to reverse and back before it will engage.

They VW dealer they bought it new from says there is no issue but there clearly is as I replicated it twice on my recent visit. Is this a known issue? What can they do to get the dealer to acknowledge ?

Yes, it's a known issue. It's also widely known that this particular automated manual is *******, and any VW dealer who pretends otherwise is following the old company line by lying. (Happily, changes are afoot within the VAG empire.) Bit late to reject it now, though. Try to get rid by part exchanging it for a decent small auto such as a KIA Picanto or a Hyundai i10.
