I bought a car advertised as having cruise control but didn't - what should the dealer do?
I bought a 2004 car last week and it seems fine except that the written list of the car's features prepared by the dealer - and shown to me before before I bought it - said that the car had cruise control. I had a 20-minute road test in it but did not notice there was no cruise control fitted. I trusted the dealer's written description. He also in writing said the mileage was 39,000, which again I didn't check but found to be 39,850 on delivery of the car. Where do I stand now? These descriptions were on an illustrated sheet of paper given to me in the showroom and on the windscreen prior to sale. I yesterday sent an email to the dealer outlining my complaint and asking if he can make amends. No reply so far.

It is traditional in the trade and at auction to describe 39,000 + as 39,000, even if it is really 39,850. I don't think you have any grounds there. But you definitely do over the cruise and can prove it with the written description you have in your possession. You can take the point of view that if the car does not have cruise it is not the car you believed you were buying and is unsuitable for the purpose it was to be put, so you can demand either for cruise to be retrofitted, for your money back, or for the car to be replaced by one with cruise.
