Bought a faulty used car - what are my legal rights?

I bought a 2003 Audi A3 a few days ago. On the drive home, I noticed the car was noisy, with a heavy knocking noise whilst idling. I took it to a local garage who advise us the duel mass flywheel is damaged (estimated over £1000 for repairs) among numerous other mechanical problems.

I called the dealer today and have started the process in line with citizens advice (sent a letter advising if no refund is given we will take court action). He said the car is our problem and we will have to take him to court to get our money back.

The car was sold with a full MoT, but I've looked online at the MoT history to find a list of advisories from the current MoT. I called the garage who carried out the MoT and according to their copy of the certificate the advisories are listed.

This means the dealer has altered the MOT certificate. Is this legal?

From what you write this guy doesn't care. He has illegally sold you an unroadworthy car and in addition to that it is faulty. You could try to involve the police and the CPS to take criminal action against him (if they have the time).

You can take civil action against him yourself in the Small Claims Track of the County Court. But he will make this as difficult as he can so it will be a long, drawn-out process and he may well even declare his business bankrupt so he has no assets from which to recover your money.
