Accident while reverse parking - who's to blame?

While reverse parking - facing oncoming traffic - a van hit my protruding passenger side front wheel. My insurance company says fault is 50/50 because the van driver had right of way. Is this correct?

Yes, because the way you describe it you were on the wrong side of the road.
