How can I stop a fraudulent whiplash claim?
Recently my wife was involved in a very minor reversing incident in a car park - both cars were reversing out of opposite spaces at the same time and there were scuff marks on both cars. Names were exchanged and we reported the incident to our insurance company. However, the other driver has now made a claim for whiplash.
Our insurer says it will be likely to be a 50/50 situation and the indications are that they will pay out just to avoid going to court where they state that they will always loose. End result is my premiums go up and loss of NCD. Our insurer say we must contact the other driver and they must deal with everything. I am so frustrated that they will get away with it at my expense - any advice as to what I can do?

Tell your insurers you are happy to go to court and testify that whiplash would have been impossible. The main reason is that both cars reversed into the backs of each other. The head restraints fitted to both cars would make whiplash impossible.
Tell the other driver you will happily see him/her in court where you will provide irrefutable proof that they are lying and if they attempt to lie in court there is a very strong chance they will be awarded a six month sentence for perjury.
